Amending O. Reg. 120/13

(GRANTS FOR STUDENT NEEDS — LEGISLATIVE GRANTS FOR THE 2013-2014 SCHOOL BOARD FISCAL YEAR)

1. Section 3 of Ontario Regulation 120/13 is amended by adding the following subsections:

(11) The Unpaid Days and Efficiency Measures form, referred to in subparagraph 4 i of subsection 16 (1), is available for public inspection at the offices of the Education Finance Branch of the Ministry of Education and on the Ministry’s website.

(12) The Statement of Attestation form, referred to in paragraphs 1, 2 and 3 of subsection 16 (1.1) and clause 16 (1.2) (a), is available for public inspection at the offices of the Education Finance Branch of the Ministry of Education and on the Ministry’s website.

(13) The memoranda of understanding referred to in clause 16 (1.2) (b) and subsection 16 (1.3) are available for public inspection at the offices of the Education Finance Branch of the Ministry of Education and on the Ministry’s website.

2. (1) Subsection 16 (1) of the Regulation is amended by adding the following paragraph:

4. The amount determined as follows:

i. For each of the board’s teachers’ bargaining units, take the amount, if any, determined under item 15 or 16 of the Unpaid Days and Efficiency Measures form, which is available as described in subsection 3 (11).

ii. Total the amounts determined under subparagraph i.

iii. Multiply the amount determined under subparagraph ii by the eligibility compliance factor for the board determined under subsection (1.1).

(2) Section 16 of the Regulation is amended by adding the following subsections:

(1.1) The eligibility compliance factor for a board is determined as follows:

1. The factor is 1 if, on or before September 30, 2013, the Minister receives the Statement of Attestation form submitted under clause (1.2) (a) or makes a confirmation in respect of the board under clause (1.2) (b).

2. The factor is 0.75 if, after September 30, 2013 but on or before October 14, 2013, the Minister receives the Statement of Attestation form submitted under clause (1.2) (a) or makes a confirmation in respect of the board under clause (1.2) (b).

3. The factor is 0.35 if, after October 14, 2013 but on or before October 31, 2013, the Minister receives the Statement of Attestation form submitted under clause (1.2) (a) or makes a confirmation in respect of the board under clause (1.2) (b).

4. The factor is 0 in all other cases.

(1.2) It is a condition of the payment of a grant to a board under this Regulation that,

(a) the board submit to the Minister the Statement of Attestation form, which is available as described in subsection 3 (12), in which the board attests to appending specified memoranda of understanding that are in respect of employees of the board to the collective agreements that apply to those employees, and the Minister approve the form; or

(b) the Minister confirm that, in his or her opinion, the board has taken reasonable steps to revise its collective agreements in accordance with the memoranda of understanding set out in subsection (1.3) that apply to employees of the board.

(1.3) The following are the memoranda of understanding referred to in clause (1.2) (b), which are available as described in subsection 3 (13):

1. The document entitled “Memorandum of Understanding 2013 between The Ministry of Education and Canadian Union of Public Employees – Ontario School Board Coordinating Committee”, dated May 10, 2013.

2. The document entitled “Memorandum of Understanding, dated August 31, 2012 between the Ministry of Education and Halton District Educational Assistants Association; Educational Assistants Association of the Waterloo Region District School Board; Dufferin-Peel Educational Resource Workers’ Association; and, Association des enseignantes et des enseignants franco-ontariens (AEFO) Collectively referred to as “the Signatory Unions”. – Update, and Memorandum of Understanding, dated July 30 2012 between the Ministry of Education and Association of Professional Student Services Personnel (APSSP) – Update, June 14, 2013”. 

3. The document entitled “Memorandum of Understanding, dated June 27, 2013, between the Ministry of Education and Canadian Office and Professional Employees, Custodian Association of Huron Perth, Educational Resource Facilitators of Peel, Essex & Kent Counties Skilled Trades, Labourers’ International Union of North America, Ontario Public Service Employees Union, Service Employees’ International Union, Unite Here”.

4. The document entitled “Memorandum of Understanding, 2013 between The Ministry of Education and l’Association des enseignantes et des enseignants franco-ontariens (AEFO) June 12, 2013”.

5. The document entitled “Memorandum of Understanding between The Government of Ontario (hereinafter called the “Government”) and Elementary Teachers’ Federation of Ontario (ETFO) (the “Union”) June 12, 2013”.

6. The document entitled “Memorandum of Understanding, dated July 5, 2012 between the Ministry of Education and the Ontario English Catholic Teachers Association – UPDATE May 16, 2013”.

7. The document entitled “Memorandum of Understanding between The Government of Ontario (hereinafter called the “Government”) and Ontario Secondary School Teachers’ Federation (the “Union”)”, dated April 9, 2013.

(1.4) The Minister may withhold part of the grant otherwise payable to a district school board under the Act if the condition set out in subsection (1.2) is not met, but may not withhold more than the amount determined for the board under section 44 for the administration and governance allocation.

(3) The French version of subsection 16 (2) of the Regulation is amended by striking out “à la condition qu’il respecte les obligations” in the portion before clause (a) and substituting “aux conditions”.

(4) The French version of clause 16 (3) (a) of the Regulation is amended by striking out “ne respecte pas une obligation” and substituting “ne respecte pas une condition”.

3. (1) Subsection 17 (1) of the Regulation is amended by adding the following paragraph:

5. The amount for the reduction in unpaid days for principals and vice-principals, determined under subsection (8).

(2) Section 17 of the Regulation is amended by adding the following subsection:

(8) The amount for the reduction in unpaid days for principals and vice-principals is the total of the amounts set out in Columns 2 and 3 of Table 0.1 opposite the name of the board.

4. Subsection 39 (1) of the Regulation is amended by adding the following paragraph:

6. Add the amount determined as follows:

i. Take the amount set out in Column 2 of Table 10.1 opposite the name of the board.

ii. Add the amount set out in Column 3 of Table 10.1 opposite the name of the board.

iii. Multiply the amount determined under subparagraph ii by the eligibility compliance factor for the board determined under subsection 16 (1.1).

5. The Regulation is amended by adding the following Tables:
