Change in ownership or ongoing custody

0.1 (1) For the purposes of subsections 30 (6) and (7) of the Act, if the new owner or new person who has ongoing custody is an individual, the following contact information is prescribed:

1.  The legal name of the individual.

2.  The name ordinarily used by the individual, if different from their legal name.

3.  The individual’s residential address.

4.  The individual’s mailing address, if different from their residential address.

5.  The individual’s primary phone number, if any.

6.  The individual’s primary e-mail address, if any. O. Reg. 315/23, s. 1.

(2) For the purposes of subsections 30 (6) and (7) of the Act, if the new owner or new person who has ongoing custody is a business, the following contact information is prescribed:

1.  The legal name of the business.

2.  Any operating names of the business.

3.  The address at which the business is located.

4.  The mailing address of the business, if different from the address at which the business is located.

5.  The business’s primary phone number, if any.

6.  The business’s primary e-mail address, if any.

7.  The name of a contact person at the business who is able to respond to inquiries about the animal and, if different from the information provided under paragraphs 5 and 6, the business’s phone number and e-mail address for the person. O. Reg. 315/23, s. 1.

Forfeiture on failure to pay account

1. (1) For the purposes of clause 35 (4) (a) of the Act, 15 business days is the prescribed period of time within which the owner or custodian must pay the stated amount. O. Reg. 447/19, s. 1 (1); O. Reg. 315/23, s. 2.

(2) For the purposes of clause 35 (4) (b) of the Act, 15 business days is the prescribed period of time within which the owner or custodian must pay the confirmed or varied amount. O. Reg. 447/19, s. 1 (2); O. Reg. 315/23, s. 2.

Abandoned animal

2. For the purposes of section 36 of the Act, five business days is the prescribed period of time within which a person must be identified as the animal’s owner or custodian.

Prescribed period for making appeal

3. For the purposes of subsection 38 (2) of the Act, 10 business days is the prescribed period of time for making an appeal to the Board. O. Reg. 315/23, s. 3.

Forfeiture of things and forfeiture of animals

4. (1) For the purposes of subsection 44 (10) of the Act, five business days is the prescribed period of time within which the identity of the person from whom the thing was seized must be ascertained.

(2) For the purposes of subsection 44 (11) of the Act, five business days is the prescribed period of time within which the identity of the person from whom the animal was seized must be ascertained.

Application by person with interest

5. For the purposes of subsection 45 (5) of the Act, five business days is the prescribed period of time within which the application must be made.

Shelter deemed to be owner

6. (1) For the purposes of section 62 of the Act, the following are prescribed entities:

1.  Every registered charity, as defined in subsection 248 (1) of the Income Tax Act (Canada), whose charitable objects include or are consistent with offering animal sheltering services.

2.  Every municipality.

3.  Every entity that has a contractual arrangement with a municipality respecting the provision of animal sheltering services. O. Reg. 642/21, s. 1.

(2) For the purposes of clause 62 (a) of the Act, five business days is the prescribed period of time within which the animal’s owner or custodian must be identified. O. Reg. 447/19, s. 6 (2).

(3) For the purposes of clause 62 (b) of the Act, five business days is the prescribed period of time within which the owner or custodian must claim the animal. O. Reg. 447/19, s. 6 (3).
