ADMINISTRATION OF VARIOUS ACTS

Note: This Regulation was revoked on the day subsection 21 (3) of the Ministry of Consumer and Business Services Statute Law Amendment Act, 2004 is proclaimed in force. See: O. Reg. 27/05, ss. 9, 10. This day has been named as July 1, 2005.

Designated Legislation

1. The following are designated as designated legislation for the purposes of subsection 3 (1) of the Act:

0.1 All provisions of the Technical Standards and Safety Act, 2000 except for sections 33, 34 and 35 and subsections 36 (1), (2) and (5).

0.2 All provisions of the regulations made under the Technical Standards and Safety Act, 2000.

Designated Administrative Authorities

1.1 For the purposes of subsection 3 (2) of the Act, the Technical Standards and Safety Authority, that is incorporated under the laws of the Province of Ontario by letters patent dated August 30, 1996 and with which the Minister of Consumer and Commercial Relations has entered into an administrative agreement dated January 13, 1997 for the purposes of section 4 of the Act, is designated as the sole administrative authority for the purpose of administering the legislation designated by paragraphs 0.1 and 0.2 of section 1. 2. For the purposes of subsection 3 (2) of the Act, the Ontario Motor Vehicle Industry Council, that is incorporated under the laws of the Province of Ontario by letters patent dated October 8, 1996 and with which the Minister of Consumer and Commercial Relations has entered into an administrative agreement dated January 6, 1997 for the purposes of section 4 of the Act, is designated as the sole administrative authority for the purpose of administering the legislation designated by paragraphs 1 and 2 of section 1. O. Reg. 159/97, s. 2.

3. For the purposes of subsection 3 (2) of the Act, the Real Estate Council of Ontario, that is incorporated under the laws of Canada by letters patent dated January 24, 1997 and with which the Minister of Consumer and Commercial Relations has entered into an administrative agreement dated March 1, 1997 for the purposes of section 4 of the Act, is designated as the sole administrative authority for the purpose of administering the legislation designated by paragraphs 3 and 4 of section 1. O. Reg. 159/97, s. 3.

3.1 For the purposes of subsection 3 (2) of the Act, the Travel Industry Council of Ontario, that is incorporated under the laws of the Province of Ontario by letters patent dated April 7, 1997 and with which the Minister of Consumer and Commercial Relations has entered into an administrative agreement dated April 29, 1997 for the purposes of section 4 of the Act, is designated as the sole administrative authority for the purpose of administering the legislation designated by paragraphs 4.1 and 4.2 of section 1. Motor Vehicle Dealers Act

4. For the purposes of subsection 20 (1) of the Motor Vehicle Dealers Act, any notice or order required to be given or served under that Act or the regulations made under it is sufficiently given or served if delivered personally or sent by registered mail addressed to the person to whom delivery or service is required to be made at the latest address for service appearing on the records of the Ontario Motor Vehicle Industry Council. Real Estate and Business Brokers Act

5. For the purposes of subsection 48 (1) of the Real Estate and Business Brokers Act, any notice or order required to be given or served under that Act or the regulations made under it is sufficiently given or served if delivered personally or sent by registered mail addressed to the person to whom delivery or service is required to be made at the latest address for service appearing on the records of the Real Estate Council of Ontario. 6. For the purposes of subsection 3 (2) of the Act, the Electrical Safety Authority, that is incorporated under the laws of the Province of Ontario by letters patent dated January 12, 1999 and with which the Minister of Consumer and Business Services has entered into an administrative agreement dated March 11, 1999 for the purposes of section 4 of the Act, is designated as the sole administrative authority for the purposes of administering the legislative provision designated by paragraph 5 of section 1.
