Amending O. Reg. 108/11

(FORMS)

1. Section 2 of Ontario Regulation 108/11 is amended by adding the following subsection:

(2.1) Despite subsection (1), a certificate of offence issued in proceedings based on evidence obtained through the use of a camera system in relation to a contravention of subsection 175 (19) or (20) of the Highway Traffic Act (duty of drivers when school bus stopped – vehicle owner) shall be in Form 2.1.

2. (1) Subsection 3 (2) of the Regulation is amended by striking out “where the offence notice requires the notice of intention to appear to be filed in person” at the end and substituting “where the notice of intention to appear is required to be filed in person”.

(2) Subsections 3 (3) and (4) of the Regulation are revoked and the following substituted:

(3) Despite subsections (1) and (2),

(a) an offence notice issued in proceedings based on evidence obtained through the use of a red light camera system shall be in Form 5; and

(b) an offence notice issued in proceedings based on evidence obtained through the use of a camera system in relation to a contravention of subsection 175 (19) or (20) of the Highway Traffic Act (duty of drivers when school bus stopped – vehicle owner) shall be in Form 5.1.

(4) Despite subsections (1), (2) and (3), in those parts of Ontario where the notice of intention to appear is required to be filed in person,

(a) an offence notice issued in proceedings referred to in clause (3) (a) shall be in Form 6; and

(b) an offence notice issued in proceedings referred to in clause (3) (b) shall be in Form 6.1.

3. Section 5 of the Regulation is amended by striking out “where the offence notice requires the notice of intention to appear to be filed in person” at the end and substituting “where the notice of intention to appear is required to be filed in person”.

4. Subsection 10 (2) of the Regulation is amended by striking out “where the parking infraction notice requires the notice of intention to appear to be filed in person” at the end and substituting “where the notice of intention to appear is required to be filed in person”.

5. Section 12 of the Regulation is amended by striking out “where the parking infraction notice requires the notice of intention to appear to be filed in person” at the end and substituting “where the notice of intention to appear is required to be filed in person”.

6. Subsection 14 (2) of the Regulation is amended by striking out “where the parking infraction notice requires the notice of intention to appear to be filed in person” at the end and substituting “where the notice of intention to appear is required to be filed in person”.

7. The Table of Forms to the Regulation is amended by adding the following rows:

Commencement

8. This Regulation comes into force on the day it is filed.
