Amending O. Reg. 340/94

(DRIVERS’ LICENCES)

1. Subsection 4 (2) of Ontario Regulation 340/94 is amended by striking out “Class B, C, D, F or G driver’s licence” in the portion before paragraph 1 and substituting “Class B, C, D, E, F or G driver’s licence”.

2. The Regulation is amended by adding the following section:

12.1 (1) An applicant for a Class A driver’s licence may not take the road test for a Class A driver’s licence until he or she has successfully completed an entry-level training course for Class A drivers approved by the Ministry.

(2) Subsection (1) does not apply to an applicant for a Class A driver’s licence who indicates that he or she intends to drive a combination of vehicles in the road test such that the Minister may impose a condition on the licence described in section 3.

(3) The holder of a Class A driver’s licence that is subject to a condition described in section 3 who applies to have the condition removed may not take the road test until he or she has successfully completed an entry-level training course described in subsection (1).

(4) An applicant for a Class A driver’s licence who surrenders a driver’s licence of an equivalent class issued by another province or a territory of Canada that has been valid for at least 12 months but less than 24 months in the last three years may be issued a Class A driver’s licence if, no later than one year after surrendering his or her licence and being issued a driver’s licence other than a Class A driver’s licence,

(a) the applicant successfully completes an entry-level training course described in subsection (1); or

(b) the applicant successfully takes the knowledge and road tests for a Class A driver’s licence.

(5) For greater certainty, an applicant described in subsection (4),

(a) may be issued a Class A driver’s licence under clause (4) (a), without being required to take the knowledge and road tests for a Class A driver’s licence; or

(b) may take the road test for a Class A driver’s licence and may be issued a Class A driver’s licence under clause (4) (b), without being required to complete an entry-level training course described in subsection (1).

3. (1) Subclause 26 (5) (e) (i) of the Regulation is amended by striking out “the Department of Foreign Affairs and International Trade of Canada” and substituting “Global Affairs Canada”.

(2) Subclause 26 (5) (f) (i) of the Regulation is amended by striking out “the Department of Foreign Affairs and International Trade of Canada” and substituting “Global Affairs Canada”.

Commencement

4. (1) Subject to subsection (2), this Regulation comes into force on the day it is filed.

(2) Section 2 comes into force on the later of July 1, 2017 and the day this Regulation is filed.
