Amending O. Reg. 134/98

(GENERAL)

1. Clauses 38 (1) (a) to (d) of Ontario Regulation 134/98 are revoked and the following substituted:

(a) if the applicant or recipient is a single person, $10,000;

(b) if the applicant or recipient has a spouse included in the benefit unit and there are no other dependants, $15,000;

(c) if the applicant or recipient has a spouse included in the benefit unit and there are one or more other dependants, $15,500 for the applicant or recipient, the spouse and one other dependant plus $500 for each additional dependant;

(d) if the applicant or recipient has no spouse included in the benefit unit and there are one or more dependants, $10,500 for the applicant or recipient and one dependant plus $500 for each additional dependant; and

2. Subsection 39 (3) of the Regulation is amended by striking out “$25,000” at the end and substituting “$50,000”.

3. (1) The Table to paragraph 1 of subsection 41 (1) of the Regulation is revoked and the following substituted:

For each additional dependant of a sole support parent, add $118 if the dependant is 18 years of age or older or $67 if the dependant is 0 to 17 years of age. Otherwise, for each additional dependant, add $98 if the dependant is 18 years of age or older or $60 if the dependant is 0 to 17 years of age.

(2) The Table to paragraph 2 of subsection 44 (1) of the Regulation is revoked and the following substituted:

(6) Paragraph 2 of subsection 44 (2) of the Regulation is revoked and the following substituted:

2. If the applicant or recipient resides north of the 50th parallel and is without year round road access, an additional amount equal to the sum of $208 for the first dependant of the dependant, $96 for the second dependant of the dependant and $100 for any subsequent dependants of the dependant.

(7) The Table to paragraph 1 of subsection 44 (3) of the Regulation is revoked and the following substituted:

(9) Paragraph 4 of subsection 44 (3) of the Regulation is revoked and the following substituted:

4. $69 (Special Boarder Allowance).

7. (1) Subsection 44.1 (2) of the Regulation is amended by striking out “and” at the end of clause (g), by revoking clause (h) and by substituting the following:

(h) not less than the sum of $143 for each member of the benefit unit, with respect to determinations relating to a month after September 30, 2016 and before October 1, 2017; and

(i) not less than the sum of $146 for each member of the benefit unit, with respect to determinations relating to a month after September 30, 2017.

(2) Subsection 44.1 (3) of the Regulation is amended by striking out “$143” and substituting “$146”.

8. The Table to subparagraph 1 ii of section 51 of the Regulation is revoked and the following substituted:

For each additional dependant, add $172 if the dependant is 18 years of age or older or $0 if the dependant is 0 to 17 years of age. The amount attributable to a dependent child shall be reduced by 50 per cent where budgetary requirements for the child were reduced under section 44.2.

9. (1) Paragraph 8 of subsection 54 (1) of the Regulation is amended by striking out “$6,000” and substituting $10,000”.

(2) Subsection 54 (1) of the Regulation is amended by adding the following paragraph:

8.1 A gift or voluntary payment received for any of the following purposes, if the gift or payment is applied as soon as practicable for the purpose for which it was intended:

i. The purchase of a principal residence for the benefit unit.

ii. The purchase of a motor vehicle referred to in paragraph 5 or 5.1 of subsection 39 (1).

iii. To pay the first and last month’s rent necessary to secure accommodation for the benefit unit.

(3) Subsection 54 (2) of the Regulation is amended by striking out “$25,000” at the end and substituting “$50,000”.

10. Paragraph 5 of subsection 55 (1) of the Regulation is amended by striking out “$80” and substituting “$82”.

11. Clauses 57 (5) (a) and (b) of the Regulation are revoked and the following substituted:

(a) $433 for the first child and $321 for each additional child if the adult applicant or recipient resides north of the 50th parallel and is without year round road access;

(b) $269 for the first child and $220 for each additional child if clause (a) does not apply;

Commencement

12. (1) Subject to subsections (2) and (3), this Regulation comes into force on August 1, 2017.

(2) Section 1 and subsections 9 (1) and (2) come into force on September 1, 2017.

(3) Sections 3, 4, 5, 6, 7, 8, 10 and 11 come into force on October 1, 2017.
