Amending O. Reg. 143/16
(QUANTIFICATION, REPORTING AND VERIFICATION OF GREENHOUSE GAS EMISSIONS)
1. Clause 4 (2.1) (c) of Ontario Regulation 143/16 is revoked and the following substituted:
(c) the owner or operator of the facility shall use the standard quantification method or methods set out in the Guideline to calculate the amount mentioned in clause (b); and
2. (1) Clause 9 (1) (c) of the Regulation is amended by adding “and a verification report” after “a verification statement”.
(2) Clause 9 (2) (c) of the Regulation is amended by adding “and a verification report” after “a verification statement”.
3. Subsection 11.1 (3) of the Regulation is revoked and the following substituted:
(3) The person shall use the standard quantification method or methods set out in the Guideline to calculate the amount of the greenhouse gas emissions associated with the use of the transferred process gas at the other facility.
4. Subsection 11.2 (3) of the Regulation is revoked and the following substituted:
(3) The person shall use the standard quantification method or methods set out in the Guideline to calculate the amount of the greenhouse gas emissions associated with the use of the natural gas at the other facility.
5. The Regulation is amended by adding the following section:
Duty to calculate indirect emissions, electricity generation
11.3 (1) This section applies in a year to the owner or operator of each of the following facilities if the owner or operator is a capped participant and pays a natural gas distributor in the year for some or all of the natural gas that is distributed to the facility located at 1741 River Road, Sarnia, at which the specified GHG activity of electricity generation is engaged in:
1. The facility located at 785 Petrolia Line, Corunna.
2. The facility located at 872 Tashmoo Avenue, Sarnia.
3. The facility located at 1900 River Road, Sarnia.
4. The facility located at 1265 Vidal Street, Sarnia.
5. The facility located at 510 Moore Line, Mooretown.
6. The facility located at 285 Albert Street, Corunna.
(2) A person to whom this section applies is prescribed for the purposes of paragraph 4 of subsection 9 (3) of the Act.
(3) The person shall use the standard quantification method or methods set out in the Guideline to calculate the amount of greenhouse gas emissions that are associated with the amount of natural gas used at the facility located at 1741 River Road, Sarnia that is paid for by the person.
(4) Subsections 4 (4), (5), (6), (7) and (8) apply, with necessary modifications, in respect of the calculation mentioned in subsection (3).
6. Subsection 12 (6) of the Regulation is amended by adding “method or” after “quantification”.
7. Clause 19 (c) of the Regulation is amended by adding “and a verification report” after “a verification statement”.
8. Paragraph 3 of subsection 23 (2) of the Regulation is revoked and the following substituted:
3. The GHG ID number assigned by the Ministry to the person or facility, as the case may be.
9. Section 27 of the Regulation is amended by adding “and a verification report prepared in accordance with section 33” after “section 32”.
10. (1) Subsection 28 (1) of the Regulation is amended by adding “and a new verification report prepared in accordance with section 33” after “section 32” in the portion before paragraph 1.
(2) Subsection 28 (2) of the Regulation is amended by striking out the portion before paragraph 1 and substituting the following:
(2) A person who is required to submit a verification statement and a verification report to the Director in respect of a revised GHG report shall submit the verification statement and the verification report to the Director within 120 days after one of the following days, as the case may be:

11. Paragraph 1 of subsection 33 (1) of the Regulation is amended by striking out “proposed”.
12. Subsection 34 (2) of the Regulation is amended by adding “and a new verification report” after “a new verification statement”.
Commencement
13. This Regulation comes into force on the later of January 1, 2018 and the day it is filed.
