Amending O. Reg. 99/02

(TEACHER PERFORMANCE APPRAISAL)

1. (1) Subsection 21 (1) of Ontario Regulation 99/02 is amended by striking out “subsection 13 (1), (2) or (4)” and substituting “subsection 13 (1), (2), (3.1) or (4)” and by striking out “Provincial Schools Negotiations Act” and substituting “Provincial Schools Authority Act”.

(2) Subsection 21 (3) of the Regulation is amended by,

(a) revoking clauses (b), (c) and (d); and

(b) adding “or, in the case of Centre Jules-Léger (École provinciale pour sourds, aveugles et sourds-aveugles), the director of education of the Centre Jules-Léger Consortium” at the end of clause (e).

2. (1) Subsection 22 (1) of the Regulation is amended by striking out “established under clause 13 (5) (a)” and substituting “established or continued under subsection 13 (5) or (5.1)”.

(2) Clause 22 (3) (a) of the Regulation is amended by adding “or, in the case of Centre Jules-Léger (École d’application), the Centre Jules-Léger Consortium” at the end.

(3) Subsection 22 (5) of the Regulation is revoked and the following substituted:

(5) Nothing in Part X.2 of the Act, or any regulation, guideline, policy or rule under that Part, shall be interpreted to limit rights otherwise available to the Ministry, the Centre Jules-Léger Consortium or a board relating to discipline of any teacher, including but not limited to rights relating to reassignment of duties, suspension or termination of the employment of the teacher, whether or not a performance appraisal process relating to the teacher is being conducted under that Part.

(4) Subsections 22 (6) and (7) of the Regulation are revoked and the following substituted:

(6) In the circumstances described in clause 277.18 (1) (b) of the Act,

(a) where no other supervisory officer employed by the Ministry is able to perform the duty and exercise the power in a timely way, because of absence or for some other reason, a supervisory officer employed by a board may, by arrangement between the Ministry and the board, perform the duty and exercise the power; or

(b) in the case of Centre Jules-Léger (École provinciale pour sourds, aveugles et sourds-aveugles) or Centre Jules-Léger (École d’application), where no other supervisory officer employed by the Centre Jules-Léger Consortium is able to perform the duty and exercise the power in a timely way, because of absence or for some other reason, a supervisory officer employed by a board may, by arrangement between the Centre Jules-Léger Consortium and the board, perform the duty and exercise the power.

Commencement

3. This Regulation comes into force on the latest of,

(a) the day subsection 1 (1) of Schedule 12 to the Stronger, Fairer Ontario Act (Budget Measures), 2017 comes into force;

(b) the day subsection 1 (4) of Schedule 12 to the Stronger, Fairer Ontario Act (Budget Measures), 2017 comes into force; and

(c) the day this Regulation is filed.
