Amending O. Reg. 284/18

(GRANTS FOR STUDENT NEEDS - LEGISLATIVE GRANTS FOR THE 2018-2019 SCHOOL BOARD FISCAL YEAR)

1. (1) Subsection 9 (1) of Ontario Regulation 284/18 is amended by adding the following paragraphs:

6.1 Memorandum 2018 SB19: Cash Management Strategy – Proceeds of Disposition, dated September 28, 2018.

19.1 Memorandum 2018 B11: Capital Funding for the 2018-19 School Year, dated April 27, 2018.

(2) Paragraph 8 of subsection 9 (1) of the Regulation is revoked and the following substituted:

8. Special Education Funding Guidelines: Special Incidence Portion (SIP), 2018-19, Revised Summer 2018.

2. (1) Section 11 of the Regulation is amended by adding the following subsection:

(3.1) Despite subsection (1), the Minister may delay payment of all or part of a legislative grant, including delaying payment of all or part of a grant to a subsequent fiscal year, if the proceeds of disposition deferred revenue balance of the board, adjusted in accordance with the document entitled “Memorandum 2018 SB19: Cash Management Strategy – Proceeds of Disposition”, dated September 28, 2018, is greater than 0.

(2) Subsection 11 (4) of the Regulation is amended by striking out “subsection (3)” and substituting “subsection (3) or (3.1)”.

3. (1) Paragraph 1 of section 19 of the Regulation is amended by striking out “$988.82” and substituting “$1,007.08”.

(2) Paragraph 2 of section 19 of the Regulation is amended by striking out “$759.54” and substituting “$773.57”.

(3) Paragraph 3 of section 19 of the Regulation is amended by striking out “$501.47” and substituting “$510.73”.

4. (1) Clause 22 (2) (a) of the Regulation is amended by striking out “2018-19” and substituting “2018-19, Revised Summer 2018”.

(2) Clause 22 (2) (b) of the Regulation is amended by striking out “$38,016” and substituting “$27,405”.

5. (1) Paragraph 5 of subsection 32 (5) of the Regulation is amended by striking out “$170,430.45” at the end and substituting “$167,912.27”.

(2) Paragraph 6 of subsection 32 (5) of the Regulation is amended by striking out “$85,215.22” and substituting “$83,956.13”.

6. Paragraph 9 of subsection 38 (1) and subsections 38 (2) and (3) of the Regulation are amended by striking out “international languages” wherever it appears and substituting in each case “international and Indigenous languages”.

7. Subparagraph 1 ii of section 40 of the Regulation is amended by striking out “$1,392.31” and substituting “$1,296.07”.

8. (1) Paragraphs 10 and 11 of subsection 50 (2) of the Regulation are revoked.

(2) Paragraph 12 of subsection 50 (2) of the Regulation is amended by striking out “paragraph 11” and substituting “paragraph 9”.

(3) Paragraph 11 of subsection 50 (6) of the Regulation is amended by striking out “$170,430.45” at the end and substituting “$167,912.27”.

(4) Paragraphs 3 to 6 and 8 to 12 of subsection 50 (21) of the Regulation are amended by striking out “$170,430.45” wherever it appears and substituting in each case “$167,912.27”.

9. The definition of “GGRF eligible expenditures” in paragraph 2 of section 65 of the Regulation is revoked and the following substituted:

“GGRF eligible expenditures” is the amount of eligible expenditures under the Greenhouse Gas Reduction Fund, as set out in the document entitled “Memorandum 2018 B11: Capital Funding for the 2018-19 School Year”, dated April 27, 2018, that the board incurred during the period beginning on September 1 of the current fiscal year and ending on March 31 of the current fiscal year and for which the board has entered into an agreement on or before June 29, 2018, and

10. This Regulation comes into force on the day it is filed.
