Amending O. Reg. 263/20

(RULES FOR AREAS IN STAGE 2)

1. Section 4 of Schedule 1 to Ontario Regulation 263/20 is amended by adding the following subsection:

(4) Subsection (1) does not apply to the rental of meeting or event space,

(a) for operations by or on behalf of a government; or

(b) for the purpose of delivering or supporting the delivery of government services.

2. (1) Subparagraph 4 i of subsection 1 (1) of Schedule 2 to the Regulation is amended by striking out “subject to subsection (4)” at the beginning.

(2) The French version of clause 1 (2) (a) of Schedule 2 to the Regulation is amended by striking out “dans l’entreprise” and substituting “pour l’entreprise”.

(3) Subsection 1 (4) of Schedule 2 to the Regulation is revoked.

(4) Subsection 3 (1) of Schedule 2 to the Regulation is amended by adding the following paragraph:

5. Providing space for the provision of an authorized recreational and skill building program within the meaning of the Child Care and Early Years Act, 2014.

(5) Section 5 of Schedule 2 to the Regulation is revoked and the following substituted:

Real estate agencies

5. (1) Real estate agencies may open if they do not host, provide or support any open house events.

(2) Nothing in subsection (1) prevents a real estate agency from showing a property by appointment.

(6) Section 8 of Schedule 2 to the Regulation is revoked and the following substituted:

Conference centres and convention centres

8. (1) Conference centres and convention centres may open if the total number of members of the public permitted to be in the conference centre or convention centre at any one time is limited to the number that can maintain a physical distance of at least two metres from every other person in the conference centre or convention centre, and in any event is not permitted to exceed,

(a) 10 persons, if the members of the public will be indoors; or

(b) 25 persons, if the members of the public will be outdoors.

(2) The capacity limits set out in subsection (1) do not apply to the rental of meeting or event space in a conference centre or convention centre,

(a) for the purpose of delivering or supporting the delivery of court services;

(b) for operations by or on behalf of a government; or

(c) for the purpose of delivering or supporting the delivery of government services.

(7) Paragraph 3 of subsection 13 (1) of Schedule 2 to the Regulation is revoked and the following substituted:

3. The total number of members of the public permitted to be at the facility in a class, organized program or organized activity at any one time must be limited to the number that can maintain a physical distance of at least two metres from other persons at the facility, and in any event cannot exceed 10 people.

3.1 Each class, organized program or organized activity must take place in a separate room.

(8) Section 13 of Schedule 2 to the Regulation is amended by adding the following subsection:

(4.1) The conditions set out in subsection (1) do not apply to facilities for indoor sports and recreational fitness activities that open to provide space for the provision of an authorized recreational and skill building program within the meaning of the Child Care and Early Years Act, 2014.

(9) Subsection 14 (1) of Schedule 2 to the Regulation is amended by adding the following paragraphs:

0.1 The total number of members of the public permitted to be at the facility in an outdoor class, organized program or organized activity at any one time must be limited to the number that can maintain a physical distance of at least two metres from other persons at the facility, and in any event cannot exceed 25 people.

0.2 Each class, organized program or organized activity must take place in a separate outdoor area.

(10) Section 16 of Schedule 2 to the Regulation is amended by adding the following paragraph:

4. Singers and players of brass or wind instruments must be separated from any other performers by plexiglass or some other impermeable barrier.

(11) Subsection 18 (1) of Schedule 2 to the Regulation is amended by striking out “subject to subsection (2)” at the end and substituting “subject to subsections (1.1) and (2)”.

(12) Section 18 of Schedule 2 to the Regulation is amended by adding the following subsection:

(1.1) Concert venues, theatres and cinemas may open for the purpose of rehearsing or performing a recorded or broadcasted concert, artistic event, theatrical performance or other performance if they comply with the following conditions:

1. No spectators may be permitted in the concert venue, theatre or cinema.

2. Every performer and other person who provides work for the concert venue, theatre or cinema must maintain a physical distance of at least two metres from every other person, except,

i. if it is necessary for the performers or other persons to be closer to each other for purposes of the performance or rehearsal, or

ii. where necessary for the purposes of health and safety.

3. Singers and players of brass or wind instruments must be separated from any other performers by plexiglass or some other impermeable barrier.

(13) Subsection 18 (3) of Schedule 2 to the Regulation is amended by striking out “10 people” and substituting “10 spectators”.

Commencement

3. This Regulation comes into force on the later of October 17, 2020 and the day it is filed.
