(CALCULATION OF FEES FOR PUPILS FOR THE 2020-2021 SCHOOL BOARD FISCAL YEAR)

1. Ontario Regulation 490/20 is amended by adding the following section:

Use of estimates

1.1 (1) For the purposes of this Regulation, the rules in this section apply in respect of a reference to an amount determined under the grant regulation or an amount determined under the A.D.E. regulation.

(2) If an amount determined under the grant regulation or the A.D.E. regulation is determined using an average daily enrolment, the amount for the purposes of this Regulation shall instead be determined using an estimate of the average daily enrolment.

(3) If an amount determined under the grant regulation or the A.D.E. regulation is determined using a count of one of the following variables, the amount for the purposes of this Regulation shall instead be determined using the board’s estimated count of the variable:

1.  The number of schools.

2.  The number of pupils.

3.  The number of teachers, teacher assistants or educators.

4.  Any other discrete variable used to determine an amount under the grant regulation or the A.D.E. regulation.

(4) If an amount determined under the grant regulation is determined using the expenses incurred by the board, the amount for the purposes of this Regulation shall instead be determined using the board’s estimated expenses.

(5) If an amount determined under the grant regulation is determined using a number set out in a Table to the grant regulation, the amount for the purposes of this Regulation shall be determined using the number that was in the Table on September 3, 2020.

(6) If the adjustment for declining enrolment is determined under the grant regulation using the amount calculated under subsection 66 (2) of Ontario Regulation 277/19 (Grants for Student Needs - Legislative Grants for the 2019-2020 School Board Fiscal Year) made under the Act, the adjustment for declining enrolment for the purposes of this Regulation shall instead be determined using an estimate of the calculated amount.

(7) If an estimate referred to in this Regulation is an estimate that is required to be submitted under subsection 232 (6) of the Act, the reference in this Regulation is to the estimate required to be submitted.

(8) In this section,

“amount” includes average, count, number, sum, total or other quantity.

2. Subparagraph 5 i of subsection 3 (3) of the Regulation is revoked and the following substituted:

i.  Multiply by $770.89 the estimated number of elementary school pupils of the board on October 31, 2020.

3. (1) Paragraphs 1 and 2 of subsection 8 (4) of the Regulation are revoked and the following substituted:

1.  Estimate the expenses of the board in the fiscal year for continuing education classes or courses.

2.  Divide the amount estimated under paragraph 1 by the continuing education A.D.E. of all pupils of the board, determined under Part IV of the A.D.E. regulation.

(2) Paragraphs 1 and 2 of subsection 8 (6) of the Regulation are revoked and the following substituted:

1.  Estimate the expenses of the board in the fiscal year for summer school classes or courses.

2.  Divide the amount estimated under paragraph 1 by the summer school A.D.E. of all pupils of the board, determined under Part V of the A.D.E. regulation.

Commencement

4. This Regulation comes into force on the day it is filed.
