Amending O. Reg. 176/10

(TEACHERS' QUALIFICATIONS)

1. Section 50.1 of Ontario Regulation 176/10 is amended by striking out “August 31” wherever it appears and substituting in each case “September 15”.

2. The Regulation is amended by adding the following sections:

Sexual abuse prevention program

Suspensions removed, expired or new certificates issued before August 16, 2022

50.3 (1) This section applies to the following members of the College, unless they have already provided evidence satisfactory to the Registrar that they have successfully completed the sexual abuse prevention program educational requirements referred to in subsection 47.2 (3) of the Act:

1.  A member whose certificate of qualification and registration was suspended as of January 1, 2022 and the suspension was removed under subsection 24 (3), section 33 or subsection 34 (1) of the Act after January 1, 2022 but before August 16, 2022.

2.  A member whose certificate of qualification and registration was suspended as of January 1, 2022 pursuant to an order of the Discipline Committee under subsection 30 (4) of the Act, an order of the Fitness to Practise Committee under subsection 31 (3) of the Act or an order of the Adjudicative Body of Chairs under subsection 29 (3) or 29.2 (1) of the Act and the suspension expired after January 1, 2022 but before August 16, 2022.

3.  A member whose certificate of qualification and registration was revoked as of January 1, 2022 and who was issued a new certificate under section 33 or subsection 34 (1) of the Act after January 1, 2022 but before August 16, 2022.

(2) Every member referred to in subsection (1) shall, on or before September 15, 2022,

(a)  complete the sexual abuse prevention program educational requirements referred to in subsection 47.2 (3) of the Act; and

(b)  provide evidence satisfactory to the Registrar that they have successfully completed the program.

(3) Despite subsection (2), the Registrar may accept evidence referred to in clause 2 (b) on or before October 15, 2022 if,

(a)  in the Registrar’s opinion, there are exceptional circumstances that prevent the member from successfully completing the program; and

(b)  the member applied for the extension on or before September 15, 2022.

Sexual abuse prevention program

Suspensions removed, expired or new certificates issued on or after August 16, 2022

50.4 (1) This section applies to the following members of the College, unless they have already provided evidence satisfactory to the Registrar that they have successfully completed the sexual abuse prevention program educational requirements referred to in subsection 47.2 (3) of the Act:

1.  A member whose certificate of qualification and registration was suspended as of January 1, 2022 and the suspension was removed under subsection 24 (3), section 33 or subsection 34 (1) of the Act on or after August 16, 2022.

2.  A member whose certificate of qualification and registration was suspended as of January 1, 2022 pursuant to an order of the Discipline Committee under subsection 30 (4) of the Act, an order of the Fitness to Practise Committee under subsection 31 (3) of the Act or an order of the Adjudicative Body of Chairs under subsection 29 (3) or 29.2 (1) of the Act and the suspension expired on or after August 16, 2022.

3.  A member whose certificate of qualification and registration was revoked as of January 1, 2022 and who was issued a new certificate under section 33 or subsection 34 (1) of the Act on or after August 16, 2022.

(2) Every member referred to in subsection (1) shall, within one month after the suspension of their certificate is removed or expires, or their new certificate is issued,

(a)  complete the sexual abuse prevention program educational requirements referred to in subsection 47.2 (3) of the Act; and

(b)  provide evidence satisfactory to the Registrar that they have successfully completed the program.

(3) Despite subsection (2), the Registrar may extend the one-month period referred to in that subsection by one additional month if,

(a)  in the Registrar’s opinion, there are exceptional circumstances that prevent the member from successfully completing the program; and

(b)  the member applied for the extension before the end of the one-month period referred to in subsection (2).

Commencement

3. This Regulation comes into force on the later of the day section 30 of Schedule 33 to the Protect, Support and Recover from COVID-19 Act (Budget Measures), 2020 comes into force and the day this Regulation is filed.
