Amending O. Reg. 364/20

(RULES FOR AREAS AT STEP 3 AND AT THE ROADMAP EXIT STEP)

1. (1) Subsection 2 (2) of Schedule 1 to Ontario Regulation 364/20 is revoked and the following substituted:

(2) The person responsible for a business or organization that is open shall operate the business or organization in compliance with the advice, recommendations and instructions issued by public health officials, including any advice, recommendations or instructions on physical distancing, cleaning or disinfecting.

(2) Paragraph 7 of subsection 2.1 (2) of Schedule 1 to the Regulation is revoked and the following substituted:

7.  The indoor areas of strip clubs.

(3) Subsection 3 (2) of Schedule 1 to the Regulation is revoked.

(4) Paragraph 4 of subsection 4 (1) of Schedule 1 to the Regulation is amended by striking out “or” at the end of subparagraph iv, by adding “or” at the end of subparagraph v and by adding the following subparagraph:

vi.  as otherwise permitted under this Order.

(5) Paragraph 8 of subsection 4 (1) of Schedule 1 to the Regulation is revoked.

(6) Subsection 4 (2) of Schedule 1 to the Regulation is amended by striking out “Paragraphs 7 and 8 of subsection (1) do not apply” at the beginning and substituting “Paragraph 7 of subsection (1) does not apply.”

(7) Section 8 of Schedule 1 to the Regulation is revoked.

2. (1) Subparagraph 3.1 ii of subsection 1 (1) of Schedule 2 to the Regulation is amended by adding “including making use of a buffet” at the end.

(2) Paragraph 3.2 of subsection 1 (1) of Schedule 2 to the Regulation is revoked.

(3) Paragraph 5 of subsection 1 (1) of Schedule 2 to the Regulation is revoked.

(4) Subsection 1 (3) of Schedule 2 to the Regulation is amended by striking out “Paragraphs 4 and 5 of subsection (1) do not apply” at the beginning and substituting “Paragraph 4 of subsection (1) does not apply”.

(5) Subsection 1 (4) of Schedule 2 to the Regulation is amended by striking out the portion before clause (a) and substituting the following:

(4) Paragraphs 1, 2 and 4 of subsection (1) do not apply,

. . . . .

(6) Paragraph 7 of subsection 2.1 (1) of Schedule 2 to the Regulation is revoked.

(7) Paragraph 2 of subsection 9 (1) of Schedule 2 to the Regulation is revoked.

(8) Paragraph 4 of section 14 of Schedule 2 to the Regulation is revoked.

(9) Paragraph 1.1 of subsection 16 (1) of Schedule 2 to the Regulation is amended by striking out “1,000 persons” and substituting “500 persons”.

(10) Paragraph 2.1 of subsection 16 (1) of Schedule 2 to the Regulation is revoked and the following substituted:

2.1  Every indoor spectator must remain seated while consuming food or drink.

(11) Paragraph 6 of subsection 16 (1) of Schedule 2 to the Regulation is revoked.

(12) Subsection 16 (4) of Schedule 2 to the Regulation is amended by striking out “Paragraphs 3, 4, 6, 7 and 8” at the beginning and substituting “Paragraphs 3, 4, 7 and 8”.

(13) Paragraph 0.1 of subsection 22 (1) of Schedule 2 to the Regulation is amended by striking out “1,000 persons” and substituting “500 persons”.

(14) Paragraphs 3 and 4 of subsection 22 (1) of Schedule 2 to the Regulation are revoked and the following substituted:

3.  Patrons must be seated at all times while,

i.  watching the concert, performance or film, or

ii.  consuming food or drink.

(15) Subsection 22 (1) of Schedule 2 to the Regulation is amended by adding the following paragraph:

7.  The person responsible for the concert venue, theatre or cinema must actively screen patrons in accordance with the advice, recommendations and instructions of the Office of the Chief Medical Officer of Health before they enter the premises of the establishment.

(16) Paragraph 3 of subsection 24 (1) of Schedule 2 to the Regulation is revoked and the following substituted:

3.  The number of members of the public at an indoor seated event or activity within the attraction at any one time must not exceed 50 per cent of the usual seating capacity for the event or activity.

(17) Paragraph 1.2 of subsection 25 (1) of Schedule 2 to the Regulation is revoked and the following substituted:

1.2  Patrons must be seated at all times while consuming food or drink.

(18) Paragraph 7 of subsection 25 (1) of Schedule 2 to the Regulation is revoked.

(19) Paragraph 3 of subsection 26 (1) of Schedule 2 to the Regulation is revoked and the following substituted:

3.  Patrons must be seated at all times while consuming food or drink.

(20) Subsection 26 (1) of Schedule 2 to the Regulation is amended by adding the following paragraph:

6.  The person responsible for the venue must actively screen patrons in accordance with the advice, recommendations and instructions of the Office of the Chief Medical Officer of Health before they enter the premises of the venue.

(21) Subsection 27 (1.2) of Schedule 2 to the Regulation is revoked and the following substituted:

(1.2) Waterparks may open if they comply with the conditions in paragraphs 2, 4 and 9 of subsection (1).

(22) Paragraph 2 of subsection 29 (1) of Schedule 2 to the Regulation is revoked.

(23) Paragraph 4 of subsection 30 (1) of Schedule 2 to the Regulation is revoked.

(24) Paragraph 2 of subsection 32 (1) of Schedule 2 to the Regulation is revoked.

(25) Paragraph 6 of subsection 32 (1) of Schedule 2 to the Regulation is revoked.

(26) Section 33 of Schedule 2 to the Regulation is revoked and the following substituted:

Bathhouses, sex clubs

33. Bathhouses and sex clubs are closed.

3. (1) Paragraph 1 of subsection 6 (2) of Schedule 3 to the Regulation is revoked and the following substituted:

1.  The number of persons occupying any room in the building or structure while attending the gathering must not exceed 50 per cent of the capacity of the particular room.

(2) Subsection 6 (3) of Schedule 3 to the Regulation is revoked.

(3) Schedule 3 to the Regulation is amended by adding the following section:

Outdoor wedding, funeral or religious service, rite or ceremony

6.1 (1) This section applies with respect to outdoor gatherings for the purposes of a wedding, a funeral or a religious service, rite or ceremony.

(2) No person shall attend a gathering to which this section applies unless the following condition is met:

1.  The number of persons attending the gathering must be limited to the number that can maintain a physical distance of at least two metres from every other person at the gathering.

(4) Subsection 7 (1) of Schedule 3 to the Regulation is revoked and the following substituted:

Opt-in re: proof of vaccination

7. (1) The person responsible for an indoor location where a wedding, a funeral or a religious service, rite or ceremony takes place may elect to require attendees to provide proof of identification and of being fully vaccinated against COVID-19 in accordance with the requirements set out in section 2.1 of Schedule 1 as if those requirements applied with respect to the location.

(5) Subsection 7 (4) of Schedule 3 to the Regulation is revoked.

Commencement

4. This Regulation comes into force on the later of January 31, 2022 and the day this Regulation is filed.
