Amending O. Reg. 197/96

(CONSENT APPLICATIONS)

1. Paragraph 4 of subsection 3 (13) of Ontario Regulation 197/96 is revoked and the following substituted:

4.  The following statement:

If a person or public body has the ability to appeal the decision of (name of the approval authority) in respect of the proposed consent to the Ontario Land Tribunal but does not make written submissions to (name of the approval authority) before it gives or refuses to give a provisional consent, the Tribunal may dismiss the appeal.

2. (1) Paragraph 2 of subsection 6 (1) of the Regulation is amended by striking out “Local Planning Appeal Tribunal” at the end and substituting “Ontario Land Tribunal”.

(2) Paragraph 4 of subsection 6 (1) of the Regulation is revoked.

3. (1) Paragraph 2 of subsection 7 (1) of the Regulation is amended by striking out “Local Planning Appeal Tribunal” at the end and substituting “Ontario Land Tribunal”.

(2) Paragraph 3 of subsection 7 (1) of the Regulation is revoked.

Commencement

4. This Regulation comes into force on the day it is filed.
