Amending O. Reg. 114/99

(FAMILY LAW RULES)

1. (1) Rule 1.1 of Ontario Regulation 114/99 is amended by adding the following subrule:

Non-application

(0.1) This rule does not apply with respect to cases commenced or continued in the City of Toronto.

(2) Subrule 1.1 (0.1) of the Regulation, as made by subsection (1), is revoked.

(3) Subrules 1.1 (1) to (3) of the Regulation are revoked and the following substituted:

Electronic filing and issuance of documents

(1) Any document that may or must be filed or issued under these rules may be submitted for filing or issuance electronically through the software authorized by the Ministry of the Attorney General that is specified in subrule (2), if,

(a)  the authorized software provides for the electronic filing or issuance of the document; and

(b)  the person requesting the filing or issuance of the document has agreed to the authorized software’s terms of use, and submitted, through the authorized software, an email address at which the person agrees to accept documents from the court electronically.

Authorized software

(2) The authorized software for the purposes of this rule is,

(a)  for a case commenced or continued in the City of Toronto, the software available on the internet under the name “Ontario Courts Public Portal” in English and “Portail public des tribunaux de l’Ontario” in French; and

(b)  for any other case, the software available on the internet through the Justice Services Online website.

(4) Subrule 1.1 (4) of the Regulation is amended by striking out “subrules (1) and (3)” and substituting “subrule (1)”.

2. The definition of “Justice Services Online website” in subrule 2 (1) of the Regulation is revoked.

3. Subclause 14 (11) (e) (iii) of the Regulation is amended by adding “or through the Ontario Courts Public Portal, whichever is available” at the end.

4. Subclause 17 (14) (c) (iii) of the Regulation is amended by adding “or through the Ontario Courts Public Portal, whichever is available” at the end.

5. Clause 26 (11) (b) of the Regulation is amended by adding “or through the Ontario Courts Public Portal, whichever is available” at the end.

6. Subclause 43 (18) (b) (iii) of the Regulation is amended by adding “or through the Ontario Courts Public Portal, whichever is available” at the end.

Commencement

7. (1) Except as otherwise provided in this section, this Regulation comes into force on the later of October 14, 2025 and the day this Regulation is filed.

(2) Subsection 1 (1) comes into force on the later of October 4, 2025 and the day this Regulation is filed.
