Amending Reg. 298 of R.R.O. 1990

(OPERATION OF SCHOOLS - GENERAL)

1. (1) The definition of “criminal background check” in subsection 22.1 (1) of Regulation 298 of the Revised Regulations of Ontario, 1990 is revoked.

(2) Subsection 22.1 (1) of the Regulation is amended by adding the following definition:

“vulnerable sector check” means, in respect of an individual,

(a)  a vulnerable sector check mentioned in paragraph 3 of subsection 8 (1) of the Police Record Checks Reform Act, 2015, and

(b)  if the individual is a resident of a jurisdiction outside of Canada, a document concerning the individual that,

(i)  was prepared by a police force or service from national data maintained by the country in which the individual resides,

(ii)  was prepared within six months before the day the board obtains the document, and

(iii)  contains the type of information authorized under the Schedule to the Police Record Checks Reform Act, 2015 to be disclosed in response to a request for a vulnerable sector check.

(3) Clause 22.1 (2) (d) of the Regulation is amended by striking out “criminal background check” and substituting “vulnerable sector check”.

Commencement

2. This Regulation comes into force on the day it is filed.
