Amending O. Reg. 391/23

(USE OF FORCE AND WEAPONS)

1. (1) The definition of “firearm” in section 1 of Ontario Regulation 391/23 is amended by striking out “PepperBall launcher” at the end and substituting “PAVA projectile launcher”.

(2) Section 1 of the Regulation is amended by adding the following definition:

“PAVA projectile launcher” means a PepperBall launcher or closely similar launcher that discharges projectiles containing PAVA or a similar irritant. (“lance-projectiles à PAVA”)

2. The Regulation is amended by adding the following section:

Duties before PAVA projectile launcher issuance

4.1 Before a PAVA projectile launcher is issued to a member of a police service, the chief of police shall ensure that the member is in compliance with the applicable training requirements prescribed by the Minister and is competent in the use of the PAVA projectile launcher.

3. Subsection 6 (1) of the Regulation is amended by striking out “4 and 5” and substituting “4, 4.1 and 5”.

4. Item 5 of Table 2 to the Regulation is revoked and the following substituted:

PAVA projectile launcher

None.

A PAVA projectile launcher may only be carried or used by a member of a tactical unit, hostage rescue team or public order unit, and only if the member is authorized to carry or use the launcher by the chief of police.
A PAVA projectile launcher may only be used to fire projectiles containing PAVA, OC or a combination of PAVA and OC.
For greater certainty, a PAVA projectile launcher shall not be carried or used by a special constable employed by the Niagara Parks Commission.

5. This Regulation comes into force on the day it is filed.
