Amending Reg. 23 of R.R.O. 1990

(POUNDS)

1. The definition of “euthanasia” in section 1 of Regulation 23 of the Revised Regulations of Ontario, 1990 is revoked and the following substituted:

“euthanasia” means to destroy an animal by the deliberate infliction of an intended death upon the animal; (“euthanasie”)

2. Clause 10 (2) (l) of the Regulation is amended by striking out “date on which it is destroyed and a statement” and substituting “date on which it is destroyed, the method of destruction used and a statement”.

3. Subsection 20 (2) of the Regulation is revoked and the following substituted:

(2) No person shall use a euthanasia method with respect to any dog or cat in a pound unless it is a method permitted under section 21.

4. Sections 21 and 22 of the Regulation are revoked and the following substituted:

21. (1) In this section,

“CCAC Euthanasia Guidelines” means the document entitled “CCAC guidelines on: euthanasia of animals used in science”, prepared by the Canadian Council on Animal Care and published on its website, as that document exists from time to time.

(2) Euthanasia may be carried out with respect to a cat in a pound using an acceptable method set out in Table 1 (Summary Chart of Acceptable Methods of Euthanasia for Experimental Animals) or Table 2 (Conditionally acceptable methods) to the CCAC Euthanasia Guidelines that is applicable to cats.

(3) Euthanasia may be carried out with respect to a dog in a pound using an acceptable method set out in Table 1 (Summary Chart of Acceptable Methods of Euthanasia for Experimental Animals) or Table 2 (Conditionally acceptable methods) to the CCAC Euthanasia Guidelines that is applicable to dogs.

(4) A reference in this section to,

(a)  a method set out in Table 1 to the CCAC Euthanasia Guidelines is a reference only to the particular method set out in the column entitled “Acceptable Methods” of that Table, and is not a reference to anything contained in the column entitled “Details and Cautions” or anything else set out in the CCAC Euthanasia Guidelines; or

(b)  a method set out in Table 2 to the CCAC Euthanasia Guidelines is a reference only to the particular method set out in the column entitled “Methods” of that Table, and is not a reference to anything contained in the column entitled “Details and Cautions” or anything else set out in the CCAC Euthanasia Guidelines.

Commencement

5. This Regulation comes into force on the day section 7 of Schedule 1 to the Keeping Criminals Behind Bars Act, 2026 comes into force.
