Amending Reg. 68 of R.R.O. 1990
(GENERAL)
1. Regulation 68 of the Revised Regulations of Ontario, 1990 is amended by adding the following section:
Exception, Verification of Identity
6.1 (1) This section applies despite subsection 7.1 (3) of the Act if the Ministry of the Solicitor General has advised the Registrar General that it is unable to determine if a person to whose name an application relates is a person described in subsection 5.1 (1) of the Act.
(2) Subsections 7 (1) and (2) of the Act do not apply until,
(a) the Registrar General requests that the person to whose name the application relates provide a criminal record check that,
(i) contains the particulars of,
(A) every criminal offence of which the person has been convicted, except an offence in respect of which, under the Criminal Records Act (Canada), a pardon has been granted or a record has been suspended, and
(B) every criminal offence of which the person has been found guilty and has been discharged, except an offence in respect of which the Criminal Records Act (Canada) requires that the record be purged,
(ii) is produced through a fingerprint search of the national repository of criminal records, established and maintained under section 57 of the Royal Canadian Mounted Police Regulations, 2014, SOR/2014-281, made under the Royal Canadian Mounted Police Act (Canada), using the person’s fingerprints, and
(iii) is certified by the Royal Canadian Mounted Police;
(b) the Registrar General has received the criminal record check and provided it to the Ministry of the Solicitor General; and
(c) based on the results of the criminal record check, the Ministry of the Solicitor General has advised the Registrar General that the person to whose name the application relates is not a person described in subsection 5.1 (1) of the Act.
Commencement
2. This Regulation comes into force on the later of the day section 3 of Schedule 2 to the Safer Streets, Stronger Communities Act, 2024 comes into force and the day this Regulation is filed.
