An Act to amend the
Auditor General Act
Assented to June 20, 2006
Her Majesty, by and with the advice and consent of the Legislative Assembly of the Province of Ontario, enacts as follows:
1. Section 4 of the Auditor General Act is amended by adding the following subsection:
Reappointment after resignation
(1.1) Despite subsection (1), if an Auditor General resigns before the expiry of his or her term of office, he or she may be appointed for a second term of office that expires no later than at the expiry of the original term of office.
2. Subsection 22 (2) of the Act is repealed and the following substituted:
Pension plan
(2) The Deputy Auditor General is a member of the Public Service Pension Plan.

(3) Subject to subsections (4) and (5), the Auditor General is a member of the Public Service Pension Plan.
Notice re pension plan
(4) Within 60 days after his or her appointment takes effect, the Auditor General may notify the Speaker in writing that the Auditor General elects not to be a member of the Public Service Pension Plan.

(5) If the Auditor General gives notice of his or her election to the Speaker in accordance with subsection (4), the election is irrevocable and is deemed to have taken effect when the appointment took effect.
Commencement
3. This Act comes into force on the day it receives Royal Assent.
Short title
4. The short title of this Act is the Auditor General Amendment Act, 2006.
