PART I
FEES PAYABLE UNDER ONTARIO REGULATION 31/05 (MEAT)

Interpretation

1. (1) In this Part,

“holiday” means,

(a) any Sunday,

(b) New Year’s Day,

(c) Good Friday,

(d) Victoria Day,

(e) Canada Day,

(f) Labour Day,

(g) Thanksgiving Day,

(h) Christmas Day,

(i) December 26;

“licensing year” means the period beginning on April 1 of one year and ending on March 31 of the following year;

“meat regulation” means Ontario Regulation 31/05 (Meat) made under the Act. O. Reg. 223/05, s. 1 (1).

(2) Where this Part requires a calculation be made with reference to a number of hours, the number of hours shall be rounded to the nearest quarter hour. O. Reg. 223/05, s. 1 (2).

Supplementary inspections

2. (1) For every inspector who performs supplementary inspections at a slaughter plant under section 138.2 of the meat regulation, the operator of the plant shall pay a fee of,

(a) $20 for every hour that the inspector performs supplementary inspections on a day other than a holiday; and

(b) $25 for every hour that the inspector performs supplementary inspections on a holiday. O. Reg. 223/05, s. 2 (1); O. Reg. 6/06, s. 1 (1, 3).

(2) The fees that would otherwise be payable under subsection (1) in respect of the first 7.25 hours of supplementary inspections performed at a slaughter plant on the first day in a licensing year, other than a holiday, on which such inspections are performed are waived, if, on that day, the operator has paid, in full, all fees for which he or she is liable under this Regulation. Fees for certain supplementary inspections not payable

2.1 (1) This section applies in respect of a slaughter plant for which a director has established an inspection schedule under section 138.1 of the meat regulation that provides for inspectors to be performing inspections at the plant for 37.5 hours on five days in a seven-day period. (2) If a director assigns inspectors to perform supplementary inspections under section 138.2 of the meat regulation at a plant described in subsection (1) on a day within the seven-day period that is not one of the five days on which inspectors are normally assigned to perform inspections under the inspection schedule, the fees that would otherwise be payable under subsection 2 (1) in respect of the first 7.25 hours of supplementary inspections performed on that day are waived unless that day is a holiday. Supplementary inspections — veterinary inspectors

3. For every veterinary inspector who performs inspections at a plant under section 138.3 of the meat regulation, the operator of a plant shall pay a fee of $40 for every hour that the veterinary inspector performs the inspections. O. Reg. 223/05, s. 3; O. Reg. 6/06, s. 3 (1).

Other services

4. For every inspector who performs services at a meat plant under section 138.4 of the meat regulation, the operator of the plant shall pay,

(a) $48 for every hour that the inspector performs services on a day other than a holiday; and

(b) $65 for every hour that the inspector performs services on a holiday. O. Reg. 223/05, s. 4.

Application for licence

5. (1) The fee for an application for the issuance or renewal of a licence under section 6 of the meat regulation is,

(a) $52.50, in respect of the 2005-2006 licensing year;

(b) $100, in respect of the 2006-2007 licensing year; and

(c) $300, in respect of subsequent licensing years. O. Reg. 6/06, s. 4 (1).

(2) Despite subsection (1), in the case of a freestanding meat plant that is first subject to the meat regulation beginning on October 1st of a year by virtue of clause 2 (1) (a), (b) or (c) of that regulation, the fee for an application for the issuance of a licence is as follows:

1. In the case of a plant that is first subject to the meat regulation on October 1, 2006, the fee is $50 in respect of the 2006-2007 licensing year.

2. In the case of a plant that is first subject to the meat regulation on October 1, 2007, the fee is $150 in respect of the 2007-2008 licensing year.

3. In the case of a plant that is first subject to the meat regulation on October 1, 2008, the fee is $150 in respect of the 2008-2009 licensing year. O. Reg. 6/06, s. 4 (1).
