Remuneration of Deputy Judges

Remuneration, per diem rates
1. A deputy judge is entitled to be paid on a per diem basis at the following rate, for each day on which he or she is entitled to remuneration:
1. For a day on or after January 1, 2022 and before January 1, 2023, a daily rate of $812.
2. For a day on or after January 1, 2023 and before January 1, 2024, a daily rate of $836.
3. For a day on or after January 1, 2024, a daily rate of $861.

Expense allowance
2. (1) A deputy judge is entitled to be reimbursed for expenses actually incurred and approved as reasonable by the Chief Justice that are incidental to the fit and proper execution of the deputy judge’s office, including,
(a) expenses incurred to facilitate remote hearings that are not otherwise covered by the Government of Ontario and for which the Government of Ontario does not otherwise provide an expense allowance or reimbursement;
(b) the purchase of one set of judicial attire associated with the office of deputy judge in a seven-year period;
(c) the maintenance of the judicial attire; and
(d) the purchase and maintenance of luggage for transporting documents and judicial attire. O. Reg. 277/25, s. 2.
(2) A deputy judge is not entitled to be reimbursed under subsection (1) for more than $750 for expenses incurred in the 12-month period beginning on January 1 in each year, other than under clause (1) (b). O. Reg. 277/25, s. 2.
(3) Subsection (2) applies to expenses incurred on or after January 1, 2025. O. Reg. 277/25, s. 2.
(4) If a deputy judge’s expenses under clause (1) (b) for the purchase of judicial attire in a 12-month period mentioned in subsection (2) exceed the amount that the deputy judge is entitled to claim for the period mentioned in subsection (2), the deputy judge may, subject to that subsection, claim the excess as an expense in respect of the following 12-month period. (5) A deputy judge is not entitled to be reimbursed under this section for expenses incurred in a 12-month period mentioned in subsection (2) unless the deputy judge sits as a deputy judge for at least one day in that period. O. Reg. 277/25, s. 2.
