GENERAL

Designated authority

1. The chief of police of a police force is the designated authority in respect of the Act and the regulations for the following officials:

1. A special constable who is a member of the police force.

2. An auxiliary member of the police force.

Note: Section 2 comes into force on June 30, 2020.

Restriction, proportion of former officials assigned to investigation

2. (1) No more than 50 per cent of the investigators assigned to conduct an investigation, other than investigators employed for the purpose of collecting, preserving, packaging and examining physical evidence, may be former officials.

(2) Subsection (1) does not apply in relation to an investigation if in the opinion of the SIU Director,

(a) adhering to the limitation set out in subsection (1) would likely result in a delay that may compromise the integrity of the investigation; or

(b) the specific requirements of the investigation necessitate that a higher proportion of investigators who are former officials be assigned.
