Reports and notices after urgent demand

1. (1) For the purposes of subsection 5 (8) of the Act, the prescribed timeframe within which an officer is required to provide a written report to the designated member of the police force is 30 days after making the urgent demand for records.

Note: On day subsection 12 (2) of Schedule 7 to the Safer Ontario Act, 2018 comes into force, subsection 1 (1) of the Regulation is amended by striking out “police force” and substituting “police service”. (See: O. Reg. 182/19, s. 3)

(2) The notice required by subsection 5 (10) of the Act,

(a) must include a description of the information the officer accessed and contact information for a member of the police force that the officer is a member of; and

(b) may be provided verbally or in writing.

(3) The officer shall provide any person who received verbal notice with a written copy of the notice upon that person’s request.

Annual report

2. (1) For the purposes of subsection 8 (1) of the Act, the prescribed date on or before which a chief of police shall prepare and provide a copy of the annual report is April 1.

(2) The annual report required by subsection 8 (1) of the Act must be provided in a format approved by the Minister.

(3) For the purposes of subsection 8 (2) of the Act, the board or entity that receives the annual report shall make it available to the public by posting it on a website on or before June 1 in the year the report is received.

(4) For the purposes of subsection 8 (3) of the Act, the Minister shall make the annual report available to the public by posting it on a website of the Government of Ontario on or before June 1 in the year the report is received.

(5) For the purposes of clause 8 (4) (c) of the Act, the annual report must also contain,

(a) the total number of times that different types of records listed in subsection 4 (2) of the Act were specified in the urgent demands made in that year; and

(b) if applicable, a description of any types of records not listed in subsection 4 (2) of the Act that were specified in the urgent demands made in that year.
