Limitation periods

1. Any provision of any statute, regulation, rule, by-law or order of the Government of Ontario establishing any limitation period shall be suspended, and the suspension shall be retroactive to Monday, March 16, 2020. O. Reg. 73/20, s. 1; O. Reg. 258/20, s. 1.

Period of time, steps in a proceeding

2. Any provision of any statute, regulation, rule, by-law or order of the Government of Ontario establishing any period of time within which any step must be taken in any proceeding in Ontario, including any intended proceeding, shall, subject to the discretion of the court, tribunal or other decision-maker responsible for the proceeding, be suspended, and the suspension shall be retroactive to Monday, March 16, 2020. Exercise of discretion

2.0.1 (1) For greater certainty, the discretion of a court or tribunal referred to in section 2 may be exercised by,

(a) the person or persons who have jurisdiction to make orders in the proceeding;

(b) the Chief Justice of Ontario, in respect of any or all of the proceedings before the Court of Appeal for Ontario;

(c) the Chief Justice of the Superior Court of Justice, in respect of any or all of the proceedings before the Superior Court of Justice;

(d) the Chief Justice of the Ontario Court of Justice, in respect of any or all of the proceedings before the Ontario Court of Justice; or

(e) the chair of a tribunal, in respect of any or all of the proceedings before the tribunal. O. Reg. 258/20, s. 3.

(2) For greater certainty, the discretion of a decision-maker referred to in section 2 may be exercised in respect of any or all of the proceedings before the decision-maker. O. Reg. 258/20, s. 3.

Application to hospital credentialing by-laws

2.1 For greater certainty and without limiting the generality of section 2, section 2 applies to by-laws made by the boards of hospitals under the Public Hospitals Act that relate to the hospital’s credentialing process, as defined in section 1 of Ontario Regulation 193/20 (Hospital Credentialing Processes). Niagara Escarpment Planning and Development Act

3. On and after April 9, 2020, sections 1 and 2 do not apply to provisions of the Niagara Escarpment Planning and Development Act or of the regulations made under it if the provisions establish a limitation period or period of time within which any step must be taken in a proceeding, including an intended proceeding. Construction Act

4. On and after April 16, 2020, sections 1 and 2 do not apply to provisions of the Construction Act or of the regulations made under it if the provisions establish a limitation period or period of time within which any step must be taken in a proceeding, including an intended proceeding. Family Responsibility and Support Arrears Enforcement Act, 1996

5. On and after June 8, 2020, sections 1 and 2 do not apply to provisions of Part V of the Family Responsibility and Support Arrears Enforcement Act, 1996 if the provisions establish a limitation period or period of time within which any step must be taken in a proceeding, including an intended proceeding. End of temporary suspension

6. For greater certainty, any limitation period or period of time within which a step must be taken in a proceeding that is temporarily suspended under this Regulation resumes running on the date on which the temporary suspension ends and the temporary suspension period shall not be counted.
