ONTARIO REGULATION 142/20

ORDER UNDER SUBSECTION 7.0.2 (4) OF THE ACT - CLOSURE OF PUBLIC LANDS FOR RECREATIONAL CAMPING

This is the English version of a bilingual regulation.

Whereas an emergency was declared pursuant to Order in Council 518/2020 (Ontario Regulation 50/20) on March 17, 2020 at 7:30 a.m. Toronto time pursuant to section 7.0.1 of the Emergency Management and Civil Protection Act (the “Act”) and has been extended pursuant to section 7.0.7 of the Act;

And Whereas the criteria set out in subsection 7.0.2 (2) of the Act have been satisfied;

Now Therefore, this Order is made pursuant to subsection 7.0.2 (4) of the Act, in particular paragraphs 2, 5 and 14 of that subsection, the terms of which are set out in Schedule 1;

And Further, this Order applies generally throughout Ontario;

And Further, this Order shall be in effect for the duration of the declared emergency, subject to section 7.0.8 of the Act.

recreational camping on public lands prohibited

Interpretation

1. For the purposes of this Order, recreational camping on public lands refers to occupying any public lands within the meaning of the Public Lands Act, including public lands covered by water or ice or both, for the purposes of outdoor recreational accommodation and includes occupying on the public lands any equipment used for the purpose of outdoor recreational accommodation such as a tent, trailer, tent-trailer, recreational vehicle, camper-back and any watercraft equipped for overnight accommodation.

Camping on public lands prohibited

2. Despite any Act or regulation that provides otherwise, recreational camping on public lands is prohibited.

Permitted activities

3. For greater certainty, nothing in this Order shall be construed as,

(a) prohibiting camping for the purposes of exercising an Aboriginal or treaty right as recognized and affirmed by section 35 of the Constitution Act, 1982;

(b) prohibiting temporary outdoor accommodations that are ancillary to or necessary for the operation of an essential business listed in Schedule 2 of O. Reg. 82/20 (Order Under Subsection 7.0.2 (4) — Closure of Places of Non-Essential Businesses);

(c) prohibiting walking through or using public lands for other permitted purposes; or

(d) affecting any written authorization given under the Public Lands Act to occupy public lands.
