ORDER UNDER SUBSECTION 7.0.2 (4) OF THE ACT - GLOBAL ADJUSTMENT FOR MARKET PARTICIPANTS AND CONSUMERS

Whereas an emergency was declared pursuant to Order in Council 518/2020 (Ontario Regulation 50/20) on March 17, 2020 at 7:30 a.m. Toronto time pursuant to section 7.0.1 of the Emergency Management and Civil Protection Act (the “Act”) and has been extended pursuant to section 7.0.7 of the Act;

And Whereas the criteria set out in subsection 7.0.2 (2) of the Act have been satisfied;

Now Therefore, this Order is made pursuant to subsection 7.0.2 (4) of the Act, in particular paragraphs 11 and 14 of that subsection, the terms of which are set out in Schedule 1;

And Further, this Order applies generally throughout Ontario.

SCHEDULE 1
GLOBAL ADJUSTMENT FOR MARKET PARTICIPANTS AND CONSUMERS

Global adjustment allocation

1. (1) The total amount of global adjustment for a month that may be allocated to non-RPP Class B market participants and consumers pursuant to Ontario Regulation 429/04 (Adjustments under Section 25.33 of the Act) made under the Electricity Act, 1998 shall be determined using a Class B rate that is the lesser of the following:

1. The Class B rate that would otherwise be determined under section 10 of that Regulation.

2. $115 per megawatt hour.

(2) Where the Class B rate is the rate referred to in paragraph 2 of subsection (1), the total amount of global adjustment for the month that may be allocated to Class A market participants and Class A consumers shall be reduced in the same proportion as the proportionate difference between the rates referred to in paragraphs 1 and 2 of that subsection.

(3) In this section,

“non-RPP Class B market participants and consumers” means Class B market participants and Class B consumers whose rates are not determined under subsection 79.16 (1) of the Ontario Energy Board Act, 1998.

Application

2. Section 1 applies with respect to electricity withdrawn from the IESO-controlled grid during the period commencing at the first instant of the day on April 1, 2020 and ending at the last instant of the day on which this Order expires, unless this Order is terminated earlier, and for greater certainty, does not affect the validity of any subsequent allocation with respect to that period that reflects the difference, if any, between the amount allocated under section 1 and the amount that would otherwise apply.
