ONTARIO REGULATION 355/20

ZONING ORDER - CITY OF KAWARTHA LAKES

Consolidation Period: From July 8, 2020 to the e-Laws currency date.

No amendments.

This Regulation is made in English only.

Definition

1. In this Order,

“Zoning By-law” means the Town of Lindsay Comprehensive Zoning By-law No. 2000-75.

Application

2. This Order applies to lands in the City of Kawartha Lakes, in the Province of Ontario, being the lands identified on a map numbered 242 and filed at the Toronto office of the Ministry of Municipal Affairs and Housing located at 777 Bay Street.

Permitted uses

3. Every use of land and every erection, location or use of any building or structure is prohibited on the lands described in section 2, except for,

(a)  single detached dwellings;

(b)  semi-detached dwellings;

(c)  duplex dwellings;

(d)  triplex dwellings;

(e)  fourplex dwellings;

(f)  townhouse dwellings;

(g)  home occupations in a dwelling;

(h)  day nurseries and day care centres;

(i)  accessory uses to a dwelling;

(j)  a model home to be used as a temporary sales office;

(k)  community parks, parks and recreation trails;

(l)  stormwater management facilities;

  (m)  public utilities, including a pump station;

(n)  an elementary school; and

(o)  accessory uses to an elementary school.

Zoning requirements

4. The zoning requirements for the uses set out in the Residential Three (R3) Zone in the Zoning By-law shall apply to the uses described in clauses 3 (a), (b), (c) and (j) with the following exceptions:

1.  The minimum front yard setback is 4.0 metres to the main front wall of a building or covered porch and 6.0 metres to a garage.

2.  The minimum interior side yard setback is 1.2 metres on one side and 0.6 metres on the other side, but this requirement shall not apply to the common wall between semi-detached dwelling units.

3.  The maximum gross floor area as a percentage of lot area is,

i.  60 per cent for single-detached and semi-detached dwellings, and

ii.  70 per cent for duplex dwellings.

4.  The maximum lot coverage for all buildings is 55 per cent.

5. The zoning requirements for the uses set out in the Residential Multiple One (RM1) Zone in the Zoning By-law shall apply to the uses described in clauses 3 (d), (e) and (f) with the following exceptions:

1.  The minimum front yard setback is 4.0 metres to the main front wall of a building or covered porch and 6.0 metres to a garage.

2.  The minimum exterior side yard setback is 2.4 metres.

3.  The minimum interior side yard setback is 1.2 metres, but this requirement shall not apply to the common wall between dwelling units.

4.  The maximum gross floor area as a percentage of lot area is 70 per cent.

5.  The maximum lot coverage for all buildings is 55 per cent.

Exception, 5.12 (j) of the Zoning By-law

6. Despite any other provision of the Zoning By-law, the zoning requirements set out in section 5.12 (j) of the Zoning By-law shall not apply to the uses described in clauses 3 (a), (b), (c), (d), (e), (f) or (j) of this Order.

Additional structures

7. In addition to the permitted encroachments set out in section 5.24 (vi) of the Zoning By-law, the following structures are permitted for the uses described in clauses 3 (a), (b), (c), (d), (e), (f) and (j) of this Order:

1.  A box or bay window may project a maximum distance of 0.6 metres into a front, rear or exterior side yard setback area.

2.  A covered porch may project a maximum distance of 1.8 metres into an exterior side yard setback area.

Community facility zone

8. The zoning requirements for the uses set out in the Community Facility (CF) Zone in the Zoning By-law shall apply to the uses described in clause 3 (n) except that the maximum height of all buildings and structures shall be no taller than a geodetic elevation of 288 metres above sea level.

Terms of use

9. (1) Every use of land and every erection, location or use of any building or structure shall be in accordance with this Order.

(2) Nothing in this Order prevents the use of any land, building or structure for any use prohibited by this Order if the land, building or structure is lawfully so used on the day this Order comes into force.

(3) Nothing in this Order prevents the reconstruction of any building or structure that is damaged or destroyed by causes beyond the control of the owner if the dimensions of the original building or structure are not increased or its original use altered.

(4) Nothing in this Order prevents the strengthening or restoration to a safe condition of any building or structure.

Deemed by-law

10. This Order is deemed for all purposes, except the purposes of section 24 of the Act, to be and to always have been a by-law passed by the council of the City of Kawartha Lakes.
