ONTARIO REGULATION 783/21

ZONING ORDER — TOWNSHIP OF PERTH EAST, COUNTY OF PERTH

Consolidation Period: From November 24, 2021 to the e-Laws currency date.

No amendments.

This Regulation is made in English only.

Definitions

1. In this Order,

“animal clinic providing animal husbandry services” means a facility where animal health care, treatment or reproductive health services are provided by one or more veterinarians and clinical animal technicians, and may include a depot for mobile veterinary or reproductive services and the temporary indoor housing of animals cared for or treated;

“farm equipment establishment” means an establishment where agricultural vehicles, implements, equipment and accessories are displayed for sale or rent and may also be serviced or repaired, but does not include a recycling or salvage yard;

“farm supply outlet” means a facility where goods that are necessary to support agricultural uses are manufactured and sold;

“storm water management facility” means a stormwater management control device, structure, or system of such physical components designed to treat, detain, store, convey, absorb, conserve, protect, or otherwise control stormwater;

“Zoning By-law” means Zoning By-law No. 30-1999 of the Township of Perth East.

Application

2. This Order applies to land in the Township of Perth East, County of Perth in the Province of Ontario, being the lands on a map numbered 275 filed at the Toronto office of the Ministry of Municipal Affairs and Housing located at 777 Bay Street.

Industrial Zone (M1-35)

3. (1) This section applies to lands located in the area shown as Industrial Zone (M1-35) on the map referred to in section 2.

(2) Every use of land and every erection, location or use of any building or structure is prohibited on the lands described in subsection (1), except for,

(a)  uses identified within the Industrial Zone (M1) of the Zoning By-law;

(b)  uses identified within the Agricultural Commercial/Industrial Zone (ACM) of the Zoning By-law;

(c)  an animal clinic providing animal husbandry services;

(d)  a farm equipment establishment;

(e)  a farm supply outlet; and

(f)  a storm water management facility.

(3) The zoning requirements set out for the Industrial Zone (M1) in the Zoning By-law apply to the uses permitted under clause (2) (a).

(4) The zoning requirements set out for the Agricultural Commercial/Industrial Zone (ACM) in the Zoning By-law apply to the uses permitted under clauses (2) (b) to (e).

(5) The zoning requirements set out for the Institutional Zone (IN) in the Zoning By-law apply to the uses permitted under clause (2) (f).

Natural Resources/Environment Zone Two (NRE2)

4. (1) This section applies to the lands located in the area shown as Natural Resources/Environment Zone Two (NRE2) on the map referred to in section 2.

(2) Every use of land and every erection, location or use of any building or structure is prohibited on the lands described in subsection (1), except for uses permitted within the Natural Resources/Environment Zone Two (NRE2) under the Zoning By-law.

(3) The zoning requirements set out for the Natural Resources/Environment Zone Two (NRE2) in the Zoning By-law apply to the uses permitted under subsection (2).

Adjacent Land Zone (ALZ)

5. (1) This section applies to lands located in the area shown as Adjacent Land Zone (ALZ) on the map referred to in section 2.

(2) Every use of land and every erection, location or use of any building or structure is prohibited on the lands described in subsection (1), except for the uses permitted within the Adjacent Land Overlay Area (AL) under the Zoning By-law.

(3) The zoning requirements set out for the Adjacent Land Overlay Area (AL) in the Zoning By-law apply to the uses permitted under subsection (2).

Terms of use

6. (1) Every use of land and every erection, location and use of buildings or structures shall be in accordance with this Order.

(2) Nothing in this Order prevents the use of any land, building or structure for any use prohibited by this Order if the land, building or structure is lawfully so used on the day this Order comes into force.

(3) Nothing in this Order prevents the reconstruction of any building or structure that is damaged or destroyed by causes beyond the control of the owner if the dimensions of the original building or structure are not increased and its original use is not altered.

(4) Nothing in this Order prevents the strengthening or restoration to a safe condition of any building or structure.

Deemed by-law

7. This Order is deemed for all purposes, except the purposes of section 24 of the Act, to be and to always have been a by-law passed by the council of the Township of Perth East.
