ZONING ORDER - TOWNSHIP OF SOUTHGATE, COUNTY OF GREY

Consolidation Period:  From March 4, 2022 to the e-Laws currency date.

No amendments.

This Regulation is made in English only.

Definitions

1. In this Order,

“back-to-back townhouse dwelling” means a residential building, other than a triplex, townhouse or apartment building, that is vertically divided with each of the dwelling units having an independent entrance at grade and each of which shares a common wall, including a side and rear wall, with adjoining dwelling units above grade;

“drive-through facility” means an establishment that provides or dispenses products or services, through an attendant or an automated machine, to persons remaining in vehicles that are in designated stacking aisles;

“fitness club” means an establishment in which facilities and equipment are available for individuals to participate in physical fitness;

“live-work townhouse dwelling” means a townhouse dwelling where a home occupation within the ground floor of the dwelling unit is permitted;

“supermarket” means a retail store for which no less than 50 per cent of the gross floor area is used exclusively for the sale and storage of food;

“Zoning By-law” means the Township of Southgate Zoning By-law 19-2002.

Application

2. This Order applies to land in the Township of Southgate, County of Grey in the Province of Ontario, being the lands on a map numbered 298 filed at the Toronto office of the Ministry of Municipal Affairs and Housing located at 777 Bay Street.

Residential Zone (R7-517)

3. (1) This section applies to lands located in the area shown as Residential Zone R7-517 on the map referred to in section 2.

(2) Every use of land and every erection, location or use of any building or structure is prohibited on the lands described in subsection (1), except for,

(a) uses permitted under section 8.1 Residential Type 1 Zone (R1) of the Zoning By-law;

(b) uses permitted under section 10.1 Residential Type 3 Zone (R3) of the Zoning By-law;

(c) uses permitted under section 11.1 Residential Type 4 Zone (R4) of the Zoning By-law;

(d) uses permitted under section 26.1 Community Facility Zone (CF) of the Zoning By-law;

(e) uses permitted under section 5.19 of the Zoning By-law;

(f) back-to-back townhouse dwellings; and

(g) live-work townhouse dwellings.

(3) The zoning requirements for the uses permitted under clause (2) (a) are the zoning requirements for the Residential Type 1 Zone (R1) set out in sections 8.2 to 8.4 of the Zoning By-law with the following exceptions:

1. The minimum required lot frontage is 9.75 metres.

2. The minimum required lot area is 300 square metres.

3. The maximum permitted lot coverage is 40 per cent.

4. The minimum required front yard setback is 6 metres.

5. The minimum required interior side yard setback is 1.2 metres on one side and 0.6 metres on the other side.

6. The minimum required exterior side yard setback is 4 metres.

7. The minimum required rear yard setback is 7.6 metres.

8. The maximum building height is 3 storeys.

(4) The zoning requirements for the uses permitted under clauses (2) (b) and (g) are the zoning requirements for the Residential Type 3 (R3) zone set out in sections 10.2 to 10.8 of the Zoning By-law, with the following exceptions:

1. The minimum lot frontage for a semi-detached dwelling is 7.25 metres.

2. The minimum lot area for a semi-detached dwelling is 225 square metres.

3. The maximum lot coverage for a semi-detached dwelling is 40 per cent.

4. The minimum front yard setback for a semi-detached dwelling is 6 metres.

5. For a semi-detached dwelling,

i. the minimum interior side yard setback is 1.5 metres for units containing an end wall, and

ii. there is no minimum interior side yard setback for units containing a common wall.

6. The minimum exterior side yard setback for a semi-detached dwelling is 4 metres.

7. The minimum rear yard setback for a semi-detached dwelling is 7.6 metres.

8. The maximum height for a semi-detached dwelling is 3 storeys.

9. The minimum lot frontage for a townhouse dwelling is 5.75 metres.

10. The minimum lot area for a townhouse dwelling is 180 square metres.

11. The maximum lot coverage for a 1 or 2 storey interior townhouse dwelling is 50 per cent.

12. The maximum lot coverage for a 1 or 2 storey end townhouse dwelling is 45 per cent.

13. The maximum lot coverage for a 3 storey townhouse dwelling is 40 per cent.

14. The minimum front yard setback for a townhouse dwelling is 6 metres.

15. For a townhouse dwelling,

i. the minimum interior side yard setback is 1.5 metres for units containing an end wall, and

ii. there is no minimum interior side yard setback for units containing a common wall.

16. The minimum exterior side yard setback for a townhouse dwelling is 4 metres.

17. The minimum rear yard setback for a townhouse dwelling is 7.6 metres.

18. The maximum height for a townhouse dwelling is 3 storeys.

19. There is no minimum play space requirement for a townhouse dwelling.

20. There is no minimum amenity area requirement for a townhouse dwelling.

21. The minimum off-street parking for a townhouse dwelling is 2 spaces per dwelling unit.

(5) The zoning requirements for the uses permitted under clause (2) (c) are the zoning requirements for the Residential Type 4 Zone (R4) set out in sections 11.2 to 11.3 of the Zoning By-law, with the following exceptions:

1. The minimum floor area per dwelling unit is 41 square metres for a bachelor unit.

2. The maximum building height is 15 metres.

3. The maximum density is 88 units per hectare.

4. There is no minimum play space requirement.

5. The minimum off-street parking, including visitor parking, is 1.5 spaces per dwelling unit.

(6) The zoning requirements for the uses permitted under clause (2) (d) are the zoning requirements for the Community Facility Zone (CF) set out in sections 26.2 to 26.6 of the Zoning By-law.

(7) The zoning requirements for the uses permitted under clause (2) (f) are as follows:

1. The minimum lot frontage for a back-to-back townhouse dwelling is 6.4 metres.

2. The minimum lot area for a back-to-back townhouse dwelling is 100 square metres.

3. The maximum lot coverage for a back-to-back townhouse dwelling is 65 per cent.

4. The minimum front yard setback for a back-to-back townhouse dwelling is 6 metres.

5. For a back-to-back townhouse dwelling,

i. the minimum interior side yard setback is 1.5 metres for units containing an end wall, and

ii. there is no minimum interior side yard setback for units containing a common wall.

6. The minimum exterior side yard setback for a back-to-back townhouse dwelling is 4 metres.

7. There is no minimum required rear yard setback for a back-to-back townhouse dwelling.

8. The maximum height for a back-to-back townhouse dwelling is 3 storeys.

9. There is no minimum play space requirement for a back-to-back townhouse dwelling.

10. There is no minimum amenity area requirement for a back-to-back townhouse dwelling.

11. The minimum off-street parking for a back-to-back townhouse dwelling unit is 2 spaces per dwelling unit.

Special Commercial Exception Z Zone (C8-Z)

4. (1) This section applies to lands located in the area shown as Special Commercial Exception Z Zone (C8-Z) on the map referred to in section 2.

(2) Every use of land and every erection, location or use of any building or structure is prohibited on the lands described in subsection (1), except for,

(a) uses permitted under section 16.1 General Commercial Zone (C2) of the Zoning By-law;

(b) uses permitted under section 26.1 Community Facility Zone (CF) of the Zoning By-law;

(c) uses permitted under section 5.19 of the Zoning By-law;

(d) medical clinics;

(e) veterinary clinics;

(f) drive-through facilities;

(g) take-out eating establishments;

(h) fitness clubs;

(i) gas bars;

(j) garden and nursery sales and supply establishments;

(k) open storage areas;

(l) open display areas;

(m) shopping centres; and

(n) supermarkets.

(3) The zoning requirements for the uses permitted under clauses (2) (a) and (d) to (n) are the zoning requirements for the General Commercial Zone (C2) set out in section 16.3 of the Zoning By-law.

(4) The zoning requirements for the uses permitted under clause (2) (b) are the zoning requirements for the Community Facility (CF) zone set out in sections 26.2 to 26.6 of the Zoning By-law.

Special Industrial Zone (M5-Z)

5. (1) This section applies to lands located in the area shown as Special Industrial Zone (M5-Z) on the map referred to in section 2.

(2) Every use of land and every erection, location or use of any building or structure is prohibited on the lands described in subsection (1), except for,

(a) uses permitted under section 22.1 General Industrial Zone (M1) of the Zoning By-law;

(b) uses permitted under section 26.1 Community Facility Zone (CF) of the Zoning By-law.

(3) The zoning requirements for the uses permitted under clause (2) (a) are the zoning requirements for the General Industrial Zone (M1) set out in sections 22.2 to 22.6 of the Zoning By-law.

(4) The zoning requirements for the uses permitted under clause (2) (b) are the zoning requirements for the Community Facility Zone (CF) set out in sections 26.2 to 26.6 of the Zoning By-law.

Environmental Protection Zone (EP)

6. (1) This section applies to lands located in the area shown as the Environmental Protection Zone (EP) on the map referred to in section 2.

(2) Every use of land and every erection, location or use of any building or structure is prohibited on the lands described in subsection (1), except for uses permitted under section 29.1 Environmental Protection Zone (EP) of the Zoning By-law.

(3) The zoning requirements set out for the uses permitted under subsection (2) are the zoning requirements for the Environmental Protection Zone (EP) set out in section 29.2 of the Zoning By-law.

Terms of Use

7. (1) Every use of land and every erection, location and use of buildings or structures shall be in accordance with this order.

(2) Nothing in this Order prevents the use of any land, building or structure for any use prohibited by this Order if the land, building or structure is lawfully so used on the day this Order comes into force.

(3) Nothing in this Order prevents the reconstruction of any building or structure that is damaged or destroyed by causes beyond the control of the owner if the dimensions of the original building or structure are not increased and its original use is not altered.

(4) Nothing in this Order prevents the strengthening or restoration to a safe condition of any building or structure.

Deemed By-law

8. This Order is deemed for all purposes, except the purposes of section 24 of the Act, to be and to always have been a By-law passed by the council of the Township of Southgate.
