ONTARIO REGULATION 40/23

ZONING ORDER - TOWNSHIP OF SEGUIN, DISTRICT OF PARRY SOUND

Consolidation Period:  From March 17, 2023 to the e-Laws currency date.

No amendments.

This Regulation is made in English only.

Definitions

1. In this Order,

“infrastructure” means structures, facilities and corridors that form the foundation for development, including sewage and water systems, sewage treatment systems, stormwater management systems, waste management systems, electricity generation facilities, electricity transmission and distribution systems, telecommunications, transit and transportation corridors and facilities and oil and gas pipelines;

“zoning by-law” means the Township of Seguin Zoning By-law 2006-125.

Application

2. This Order applies to lands in the Township of Seguin in the Territorial District of Parry Sound, in the Province of Ontario, being the lands identified on a map numbered 323 and filed at the Toronto office of the Ministry of Municipal Affairs and Housing located at 777 Bay Street.

Mixed Use Zone

3. (1) Every use of land and every erection, location or use of any building or structure is prohibited on the land located in the area shown as the Mixed Use (MU) Zone on the map described in section 2.

(2) Despite subsection (1), the following uses are permitted on the lands referred to in subsection (1):

1. Residential uses.

2. Home occupations, as defined in the zoning by-law.

3. Commercial uses.

4. Recreation and athletic facilities, including a community centre, a recreation club, an ice or roller skating rink, a curling rink, an indoor paintball facility, an axe throwing facility, a racquet club, a swimming pool, a golf driving range, a billiard hall, a bowling alley or other similar facilities where the principal focus of the use is participation in athletic or recreation activities.

5. Institutional uses, buildings or structures that are publicly or privately owned and that are used by a government, organization, group, or association for public, religious, charitable, educational, benevolent, health, safety or welfare purposes.

6. Long-term care homes, as defined in the Fixing Long-Term Care Act, 2021, and assisted living homes.

7. Cohousing buildings and structures that include both private dwelling units and shared spaces to facilitate interaction between neighbours and provide social, economic and environmental benefits.

8. Retirement homes, as defined in the Retirement Homes Act, 2010.

9. Supportive housing made up of single dwelling units in a residential dwelling of any kind, other than a correctional facility, that is licensed, approved or funded under federal or provincial statute for the accommodation of three to 10 residents, exclusive of staff, and that provides a supervised group living arrangement.

10. Health clinics.

11. Day care centres.

12. Parks and other open spaces.

13. Public uses, as defined in the zoning by-law.

14. Infrastructure uses.

Environmental Protection 1 Zone

4. (1) Every use of land and every erection, location or use of any building or structure is prohibited on the land located in the area shown as the Environmental Protection 1 (EP1) Zone on the map described in section 2.

(2) Despite subsection (1), the following uses are permitted on the lands referred to in subsection (1):

1. The uses set out as permitted uses for the EP1 Zone in section 11.2 of the zoning by-law.

2. Infrastructure uses.

Mixed Use Exception 1 Zone

5. (1) Every use of land and every erection, location or use of any building or structure is prohibited on the land located in the area shown as the Mixed Use Exception 1 (MU-1) Zone on the map described in section 2.

(2) Despite subsection (1), the following uses are permitted on the lands referred to in subsection (1):

1. The uses set out as permitted uses for the C5 Zone in section 7.2 of the zoning by-law.

2. The uses permitted under subsection 3 (2) of this Order.

Mixed Use Exception 2 Zone

6. (1) Every use of land and every erection, location or use of any building or structure is prohibited on the land located in the area shown as the Mixed Use Exception 2 (MU-2) Zone on the map described in section 2.

(2) Despite subsection (1), the following uses are permitted on the lands referred to in subsection (1):

1. The uses set out as permitted uses for the C3-25(H) Zone in section 7.4 of the zoning by-law.

2. The uses permitted under subsection 3 (2) of this Order.

Mixed Use Exception 3 Zone

7. (1) Every use of land and every erection, location or use of any building or structure is prohibited on the land located in the area shown as the Mixed Use Exception 3 (MU-3) Zone on the map described in section 2.

(2) Despite subsection (1), the following uses are permitted on the lands referred to in subsection (1):

1. The uses set out as permitted uses for the MP Zone in section 8.2 of the zoning by-law.

2. The uses permitted under subsection 3 (2) of this Order.

Terms of use

8. (1) Every use of land and every erection, location and use of any building or structure shall be in accordance with this Order.

(2) Nothing in this Order prevents the use of any land, building or structure for any use prohibited by this Order if the land, building or structure is lawfully so used on the day this Order comes into force.

(3) Nothing in this Order prevents the reconstruction of any building or structure that is damaged or destroyed by causes beyond the control of the owner if the dimensions of the original building or structure are not increased and its original use is not altered.

(4) Nothing in this Order prevents the strengthening or restoration to a safe condition of any building or structure.

Deemed by-law

9. This Order is deemed for all purposes, except the purposes of section 24 of the Act, to be and to always have been a by-law passed by the council of the Township of Seguin.

10. Omitted (provides for coming into force of provisions of this Regulation).
