ZONING ORDER — TOWN OF INNISFIL, COUNTY OF SIMCOE

This Regulation is made in English only.

Definition

1. In this Order,

“portal structure” means a freestanding or attached structure that serves as an entrance, entrance feature or passageway that may consist of vertical supports and a horizontal beam or arch spanning an opening, and may form part of a rooftop, building facade, gateway, canopy or decorative element associated with access to a property, building or defined area.

“zoning by-law” means Zoning By-law No. 080-13 of the Town of Innisfil.

Application

2. This Order applies to lands in the Town of Innisfil in the County of Simcoe, in the Province of Ontario, being lands outlined in red on a map numbered 369 and filed at the Toronto office of the Ministry of Municipal Affairs and Housing located at 777 Bay Street.

Commercial Tourist Zone

3. (1) In addition to the uses permitted by the zoning by-law, a gaming facility is permitted on the lands located in the area shown as “Commercial Tourist Zone” on the map referred to in section 2.

(2) The zoning requirements for the uses permitted under subsection (1) are the zoning requirements set out in the zoning by-law, with the following exceptions:

1.  The maximum building height for a hotel is 30 metres.

2.  The maximum height for portal structures associated with a gaming facility is 19 metres, measured from established grade to the top of the structure.

3.  There is no maximum building height for a rooftop or penthouse structures accommodating,

i.  an elevator, staircase, tank, ventilating fan or other similar equipment, or

ii.  a smokestack, communications tower or other utilitarian structures that do not provide habitable space.

4.  The minimum landscaped open space is 7 per cent of the lot area, excluding the area within the 14-metre setback from Reive Boulevard.

5.  A minimum of three loading spaces shall be provided.

6.  Patios and covered or uncovered outdoor patios are permitted in any yard.

7.  The minimum parking standards are the following:

i.  For a gaming facility use, a minimum of one parking space for every 23 square metres of gross floor area shall be provided.

ii.  For a hotel use, a minimum of one parking space for every guest room of the hotel shall be provided, in addition to the parking spaces that are required by the zoning by-law for the accessory uses of the hotel use.

iii.  For a restaurant use, a minimum of one parking space for every 8 square metres of gross floor area that is accessible to patrons or one parking space for every four persons that can be accommodated in the design capacity of the restaurant, whichever is greater, shall be provided.

iv.  For an office use, a minimum of one parking space for every 28 square metres of gross floor area of the first floor shall be provided, in addition to one parking space for every 37 square metres of gross floor area for any floor above the first floor.

Environmental Protection Zone

4. (1) Every use of land and every erection, location or use of any building or structure is prohibited on the lands located in the area shown as “Environmental Protection Zone” on the map referred to in section 2, except for the uses permitted in the Environmental Protection Zone described in the zoning by-law.

(2) Despite subsection (1), surface parking areas are permitted in the Environmental Protection Zone for the uses mentioned in subparagraphs 7 i to iv of subsection 3 (2) in order to fulfil the minimum parking requirements set out in that subsection.

(3) Despite subsection (1), landscaping and any associated infrastructure appurtenances are permitted in the Environmental Protection Zone.

Terms of use

5. (1) Every use of land and every erection, location and use of buildings or structures shall be in accordance with this Order.

(2) Nothing in this Order prevents the use of any land, building or structure for any use prohibited by this Order if the land, building or structure is lawfully so used on the day this Order comes into force.

(3) Nothing in this Order prevents the reconstruction of any building or structure that is damaged or destroyed by causes beyond the control of the owner if the dimensions of the original building or structure are not increased and its original use is not altered.

(4) Nothing in this Order prevents the strengthening or restoration to a safe condition of any building or structure.

Deemed by-law

6. This Order is deemed for all purposes, except the purposes of section 24 of the Act, to be a by-law passed by the council of the Town of Innisfil.
