DESIGNATION OF WASTE

This Regulation is made in English only.
1. In this Regulation,
“site” means the site known as the Toronto Harbour Commissioners Constructed Dredged Storage Enclosure located on the south side of the Leslie Street spit in the City of Toronto. R.R.O. 1990, Reg. 342, s. 1.
2. The contaminated sediments located in the Keating Channel and in the lower Don River in the City of Toronto are designated as a waste for the purposes of the definition of “waste” in section 25 of the Act. R.R.O. 1990, Reg. 342, s. 2.
3. The waste designated by section 2 is exempt from section 30 of the Act so long as it is located at the locations referred to in section 2 or is being removed and transported to or stored at the site. R.R.O. 1990, Reg. 342, s. 3.
4. The exemption provided by section 3 is subject to the condition that the waste is not removed, transported to or stored at the site except pursuant to a certificate of approval or provisional certificate of approval issued under Part V of the Act for the use, operation, establishment, alteration or enlargement of the site that prohibits the disposal of waste at the site, except in accordance with an approval issued under the Environmental Assessment Act.
