FEES PAYABLE UNDER VARIOUS ACTS

Agricultural and Horticultural Organizations Act

0.1 The following fees shall be paid for the incorporation of an organization under the Agricultural and Horticultural Organizations Act:

1. $100 for agricultural associations.

2. $25 for agricultural societies.

3. $25 for horticultural societies. O. Reg. 21/91, s. 1.

Ambulance Act

1. The following fees shall be paid in respect of an emergency medical care examination set by the Director of the Emergency Health Services Branch of the Ministry of Health:

1.

For an emergency medical care examination under subsection 12 (2) of Regulation 19 of the Revised Regulations of Ontario, 1990

(2) No fee shall be charged under subsection (1) in respect of a complaint if,

(a) the complainant has filed a previous complaint with the Assessment Review Board in accordance with the Assessment Act in respect of a previous year assessment of the same property;

(b) there has been no material change to the property since that filing;

(c) there has been no reassessment of the municipality since that filing; and

(d) the Assessment Review Board has not issued a decision on the previous complaint or has issued a decision and the complainant has filed an appeal to the Ontario Municipal Board that is still before the Board. O. Reg. 603/93, s. 1.

1.3 (1) The following fees are payable in respect of the following proceedings brought before the Assessment Review Board under section 40 of the Assessment Act:

(2) A complainant shall not be required to pay a fee in excess of $1,000 in respect of the assessment of a property. O. Reg. 676/94, s. 2.

(3) No fee shall be charged if a complaint made with respect to a previous assessment in respect of the same roll number has not been finally determined and disposed of by the Assessment Review Board, the Ontario Municipal Board or the courts by the last date for mailing or delivering the complaint to the Assessment Review Board pursuant to subsection 40 (2) of the Assessment Act. (4) Subsection (3) does not apply to complaints following a general reassessment of the upper-tier, lower-tier or single-tier municipality in which the property is located. O. Reg. 676/94, s. 2; O. Reg. 367/02, s. 1.

(5) Where additional roll numbers have been created for a property and the complainant, on motion, satisfies the chair or vice-chair of the Board that the application of subsection (1) would be unfair, the chair or vice-chair, as the case may be, may order that the fees payable be calculated as if such additional roll numbers had not been created. 1.4 Section 1.3 applies to the assessment roll returned for taxation in 1995 and subsequent years and to any assessment under section 33 or 34 of the Assessment Act for which notice is mailed or delivered to the assessed person after January 1, 1995. O. Reg. 676/94, s. 2; O. Reg. 29/99, s. 2.

City of Toronto Act, 2006

1.5 The following fees are payable in respect of the following proceedings brought before the Assessment Review Board under section 322, 323, 325 or 326 of the City of Toronto Act, 2006:

Employment Standards Act

2. The following fees shall be paid to obtain a copy of a decision made by a referee under section 68 of the Employment Standards Act or a copy of an order, including the findings of fact, made by a referee under subsection 69 (2) of that Act:

1. $4,500 for one copy of every decision and order that is in the possession of the Director of Employment Standards made from the 1st day of January, 1971 to the 31st day of December, 1987.

2. $375 for one copy of every decision and order that is in the possession of the Director of Employment Standards made in any one year beginning with 1988.

3. 50 cents per page for a copy of any decision or order that is in the possession of the Director of Employment Standards, other than a copy obtained by paying the fee prescribed in paragraph 1 or 2. R.R.O. 1990, Reg. 678, s. 2.

Health Insurance Act

2.1 (1) A fee for processing a claim for the cost of insured services under the Health Insurance Act is payable in the circumstances described in subsection 38.3 (3) of Regulation 552 of the Revised Regulations of Ontario, 1990. O. Reg. 87/93, s. 1.

(2) The fee is $1.87 and it is payable by the physician, practitioner, health facility or laboratory that rendered the insured services. O. Reg. 360/02, s. 1.

(3) The fee shall be paid to the General Manager of the Ontario Health Insurance Plan. O. Reg. 87/93, s. 1.

Hospital Labour Disputes Arbitration Act

3. The fee for copies of an award filed under subsection 9 (1) of Regulation 639 of the Revised Regulations of Ontario, 1990 is 50 cents per page. R.R.O. 1990, Reg. 678, s. 3.

Labour Relations Act

4. The following fees are payable for copies of arbitrators’ decisions filed under subsection 4 (1) of Regulation 684 of the Revised Regulations of Ontario, 1990 made under the Labour Relations Act:

1. To purchase a copy of every award filed in a one-year period, $4,400.

2. To purchase a copy of an award, 50 cents per page, if the purchaser has not paid the fee described in paragraph 1. O. Reg. 382/92, s. 1; O. Reg. 422/94, s. 1; O. Reg. 486/95, s. 1; O. Reg. 90/96, s. 1.

Lakes and Rivers Improvement Act

4.1 (1) Subject to subsection (2), a fee of $50 shall be paid for processing an application under the Lakes and Rivers Improvement Act for,

(a) approval of the location of a dam and the plan and specifications of the dam;

(b) approval of the plans and specifications of improvements to a dam. O. Reg. 337/93, s. 1.

(2) No fee shall be charged,

(a) under clause (1) (a) if a fee has been paid under section 1 of Regulation 972 of the Revised Regulations of Ontario, 1990 for a work permit issued in respect of the construction of the dam; or

(b) under clause (1) (b) if a fee has been paid under section 1 of Regulation 972 of the Revised Regulations of Ontario, 1990 for a work permit issued in respect of the improvements to the dam. O. Reg. 337/93, s. 1.

Liquor Control Act

5. (1) A person appointed as a sacramental wine vendor by the Liquor Control Board shall pay an annual fee of,

(a) $25; and

(b) 10½ per cent of the gross selling price of all sacramental wine sold. R.R.O. 1990, Reg. 678, s. 5 (1).

(2) For the purpose of subsection (1), gross selling price does not include Ontario Retail Sales Tax. R.R.O. 1990, Reg. 678, s. 5 (2).

Municipal Act, 2001

5.1 The following fees are payable in respect of the following proceedings brought before the Assessment Review Board under section 356, 357, 358 or 359 of the Municipal Act, 2001:

Paperback and Periodical Distributors Act

6. The fee payable upon application to the Registrar for registration as a distributor under subsection 3 (1) of the Paperback and Periodical Distributors Act, or for maintenance, is $190. O. Reg. 518/97, s. 1.

Pension Benefits Act

7. (1) Where the Superintendent causes work to be done on a report on a plan under section 4 of Regulation 909 of the Revised Regulations of Ontario, 1990, as amended by Ontario Regulation 712/92, the Superintendent shall charge a fee, to be paid promptly by the administrator for the plan from the pension fund, equal to the cost of the actuarial services reasonably incurred by the Crown for work done on the report, excluding the cost of actuarial services of Crown employees.
