NURSING BURSARIES

This Regulation is made in English only.

1. In this Regulation,

“facility” means ,

(a) a board of health within the meaning of the Health Protection and Promotion Act,

(b) a home for the aged within the meaning of the Homes for the Aged and Rest Homes Act,

(c) a hospital within the meaning of the Public Hospitals Act,

(d) a institution within the meaning of the Mental Hospitals Act, or

(e) a nursing home within the meaning of the Nursing Homes Act;

“nursing bursary” means a bursary for a student’s last or second last academic year of a nursing program at,

(a) the Ryerson Polytechnical Institute,

(b) a university listed in Schedule 1,

(c) a college listed in Schedule 2, or

(d) a hospital listed in Schedule 3;

“qualified applicant” means an applicant for a bursary who,

(a) makes his or her home and is ordinarily present in Ontario,

(b) made his or her home and was ordinarily present in Ontario for the two years immediately preceding the application, and

(c) is legally entitled to remain in Canada. R.R.O. 1990, Reg. 789, s. 1.

2. (1) The Minister may pay a nursing bursary under section 10 of the Act to a qualified applicant.

(2) The amount of a nursing bursary under subsection (1),

(a) for a full-time student is $7,500; or

(b) for a part-time student is $7,500 multiplied by the number of credits to be taken in the academic year for which the bursary applies divided by the minimum number of credits for a full-time academic year.

(3) The following are conditions of a bursary under subsection (1):

1. The applicant shall practise nursing for a period equal to one year multiplied by the amount of the bursary divided by $7,500 as a full-time employee at a qualifying facility.

2. In paragraph 1, a qualifying facility is a facility in which the nursing vacancy rate is above the average nursing vacancy rate, as determined by the Minister, for similar facilities in the same geographic area.

3. The applicant shall begin to practise nursing for the period set out in paragraph 1,

i. for the first bursary received by an applicant under subsection (1), within three months of the completion of the applicant’s nursing program, or

ii. for the second bursary received by an applicant under subsection (1), at the end of the period the applicant is required to practise nursing as a condition of the first bursary the applicant received.

4. If a condition set out in paragraph 1 or 3, for any bursary the applicant received, is not met or if the applicant discontinues his or her program before completion or fails to successfully complete his or her program, the applicant shall make a payment to the Minister in accordance with paragraph 5.

5. A payment under paragraph 4 shall be made within three months of the Minister requesting payment and shall be equal to the amount of the bursary minus the product of $7,500 and the proportion of a year, if any, that the applicant practised nursing as required by the condition set out in paragraph 1. 2.1 (1) A person who received a nursing bursary and who failed to satisfy a condition set out in paragraph 1 or 3 of subsection 2 (3) is relieved from making a payment under paragraph 4 of that subsection if,

(a) the person practises for the full amount of time required under subsection (2); or

(b) the person practises for part of the time required under subsection (2) and makes the payment under subsection (3).

(2) A person is relieved under clause (1) (a) if the person practises as a nurse in Ontario in accordance with the following:

1. The person begins to practise nursing within two years after the completion of the person’s nursing program.

2. The person practises nursing for a number of hours determined by multiplying 1,500 hours times the amount of the bursary divided by $7,500.

3. The person completes the number of hours required under paragraph 2 within two years of beginning to practise nursing.

(3) The payment referred to in clause (1) (b) is a payment to the Minister equal to the amount of the bursary minus the product of $7,500 times the part of the time required under subsection (2), measured in hours, that the person practised divided by 1,500 hours. O.Reg. 709/92, s. 1.

3. (1) The Minister may pay a continuing education nursing bursary under section 10 of the Act to a qualified applicant who is practising nursing as an employee at a facility if the employer pays the applicant a nursing bursary.

(2) The amount of a continuing education nursing bursary under subsection (1) shall be equal to the amount of the nursing bursary paid to the applicant by the applicant’s employer but shall not exceed $3,750.

(3) The following are conditions of a continuing education nursing bursary under subsection (1):

1. The applicant shall practise nursing as an employee at the facility mentioned in subsection (1) for a period equal to one year.

2. The applicant shall begin to practise nursing for the period set out in paragraph 1,

i. for the first bursary received by an applicant under subsection (1), within three months of the completion of the applicant’s nursing program, or

ii. for the second bursary received by an applicant under subsection (1), at the end of the period the applicant is required to practise nursing as a condition of the first bursary the applicant received.

3. If a condition set out in paragraph 1 or 2, for any bursary the applicant received, is not met or if the applicant discontinues his or her program before completion or fails to successfully complete his or her program, the applicant shall make a payment to the Minister in accordance with paragraph 4.

4. A payment under paragraph 3 shall be made within three months of the Minister requesting payment and shall be equal to the amount of the bursary minus the product of the amount of the bursary and the proportion of a year, if any, that the applicant practised nursing as required by the condition set out in paragraph 1. R.R.O. 1990, Reg. 789, s. 3.

3.1 (1) A person who received a continuing education nursing bursary and who failed to satisfy a condition set out in paragraph 1 or 2 of subsection 3 (3) is relieved from making a payment under paragraph 3 of that subsection if,

(a) the person practises for the full amount of time required under subsection (2); or

(b) the person practises for part of the time required under subsection (2) and makes the payment under subsection (3).

(2) A person is relieved under clause (1) (a) if the person practises as a nurse in Ontario in accordance with the following:

1. After completion of the person’s nursing program, the person practises as a nurse at the facility mentioned in subsection 3 (1) or, if the person is unable to do so, practises as a nurse elsewhere in Ontario.

2. The person begins to practise in accordance with paragraph 1 within two years after the completion of the person’s nursing program.

3. The person practises nursing for one year.

4. The person completes the one year required under paragraph 3 within two years of beginning to practise in accordance with paragraph 1.

(3) The payment referred to in clause (1) (b) is a payment to the Minister equal to the amount of the bursary minus the product of the amount of the bursary times the fraction of a year that the person practised as required under subsection (2). O.Reg. 709/92, s. 1.

4. It is a condition of a nursing bursary or continuing education nursing bursary that if an applicant is required under paragraph 4 of subsection 2 (3) or paragraph 3 of subsection 3 (3) to pay the Minister an amount the applicant shall also pay the Minister interest on the amount calculated monthly from the time the bursary was received at a rate for each month equal to the Bank of Canada rate on the last day of the preceding month as set out in the Bank of Canada Weekly Financial Statistics.
