ONTARIO REGULATION 785/91

LEVIES OR CHARGES — EGGS

This Regulation is made in English only.

1. In this Regulation,

“eggs” means eggs of a domestic hen that are produced in Ontario, other than hatching eggs.  O. Reg. 785/91, s. 1.

2. (1) The Lieutenant Governor in Council grants to the Canadian Egg Marketing Agency constituted under the Farm Products Marketing Agencies Act (Canada), in relation to the marketing of eggs locally within Ontario, authority,

(a) to fix and impose levies or charges and to collect them from persons engaged in the production of eggs in Ontario;

(b) to classify those persons into groups and fix the levies or charges payable by the members of the different groups in different amounts, not exceeding 4 cents per dozen eggs; and

(c) to use those levies or charges for its purposes, including the creation of reserves.  O. Reg. 785/91, s. 2 (1); O. Reg. 164/94, ss. 1, 2; O. Reg. 12/95, s. 1; O. Reg. 135/96, s. 1; O. Reg. 284/08, s. 1.

(2) The Lieutenant Governor in Council grants to The Ontario Egg Producers’ Marketing Board, in relation to the marketing of eggs locally within Ontario, authority,

(a) to fix and impose levies or charges and to collect them from persons engaged in the production of eggs in Ontario;

(b) to classify those persons into groups and fix the levies or charges payable by the members of the different groups in different amounts; and

(c) to use those levies or charges for its purposes, including the creation of reserves, the payment of expenses and losses resulting from the sale or disposal of any eggs and the equalization or adjustment among producers of eggs of money realized from their sale during such period or periods as it may determine.  O. Reg. 785/91, s. 2 (2).

(3) The grant of authority under subsections (1) and (2) does not include the authority to fix, impose and collect levies or charges granted to The Ontario Egg Producers’ Marketing Board by Regulation 83 of the Revised Regulations of Ontario, 1990.  O. Reg. 785/91, s. 2 (3).

3. (1) A grader of eggs or grading station operator who receives eggs shall deduct from the money payable for the eggs any levies or charges payable to the Canadian Egg Marketing Agency by the person from whom the grader or grading station operator receives the eggs and shall forward them to The Ontario Egg Producers’ Marketing Board as agent for the Canadian Egg Marketing Agency not later than ten days after the last day of the week in which the grader or grading station operator receives the eggs.  O. Reg. 785/91, s. 3 (1).

(2) A grader of eggs or grading station operator who receives eggs shall deduct from the money payable for the eggs any levies or charges payable to The Ontario Egg Producers’ Marketing Board by the person from whom the grader or grading station operator receives the eggs and shall forward them to the marketing board not later than ten days after the last day of the week in which the grader or grading station operator receives the eggs.  O. Reg. 785/91, s. 3 (2).

4. The Canadian Egg Marketing Agency shall, at any time during normal office hours, make available to an auditor designated by the Minister of Agriculture and Food, all books of account, records and documents relating to the receipt of funds under this Regulation and its expenditures of money derived in whole or in part from funds received under this Regulation.  O. Reg. 785/91, s. 4.
