TOWNSHIP OF STEPHEN, VILLAGE OF
GRAND BEND BOUNDARY

This Regulation is made in English only.

1. On the 1st day of January, 1993, the portion of the Township of Stephen described in the Schedule is annexed to the Village of Grand Bend. O. Reg. 788/92, s. 1.

2. All real property including any highway, street fixture, waterline, sewerline, easement and restrictive covenant running with the land in the annexed area of The Corporation of the Township of Stephen vests in The Corporation of the Village of Grand Bend on the 1st day of January, 1993. O. Reg. 788/92, s. 2.

3. On the 1st day of January, 1993, the by-laws of The Corporation of the Village of Grand Bend extend to the annexed area and the by-laws of The Corporation of the Township of Stephen cease to apply to such area, except,

(a) by-laws of The Corporation of the Township of Stephen,

(i) that were passed under section 34 or 42 of the Planning Act or a predecessor of those sections,

(ii) that were kept in force by subsection 13 (3) of The Municipal Amendment Act, 1941, or

(iii) that were passed under the Highway Traffic Act or the Municipal Act that regulate the use of highways by vehicles and pedestrians and that regulate the encroachment or projection of buildings or any portion thereof upon or over highways,

which shall remain in force until repealed by the council of The Corporation of the Village of Grand Bend;

(b) by-laws of The Corporation of the Township of Stephen passed under section 3 of the Development Charges Act which shall remain in force until the earlier of,

(i) the date they are repealed by the council of The Corporation of the Village of Grand Bend, and

(ii) the date they expire under subsection 6 (1) or (2) of the Development Charges Act;

(c) by-laws of The Corporation of the Township of Stephen passed under section 45, 58 or 61 of the Drainage Act or a predecessor of those sections; and

(d) by-laws conferring rights, privileges, franchises, immunities or exemptions that could not have been lawfully repealed by the council of The Corporation of the Township of Stephen. O. Reg. 788/92, s. 3.

4. The clerk of The Corporation of the Township of Stephen shall promptly prepare and furnish to the clerk of The Corporation of the Village of Grand Bend a special collector’s roll showing all arrears of taxes or special rates assessed against the land in the annexed area up to and including the 31st day of December, 1992 and the persons assessed therefor. 5. (1) All real property and business taxes levied under any general or special Act and uncollected in the annexed area which are due and unpaid on the 31st day of December, 1992 shall be deemed on the 1st day of January, 1993 to be taxes due and payable to The Corporation of the Village of Grand Bend and may be collected by The Corporation of the Village of Grand Bend.

(2) On or before the 1st day of July, 1993, The Corporation of the Village of Grand Bend shall pay to The Corporation of the Township of Stephen an amount equal to the amount of all real property and business taxes that The Corporation of the Village of Grand Bend is entitled to collect in the annexed area under subsection (1), that were due but unpaid on the 31st day of December, 1992. 6. For the purposes of the assessment roll to be prepared for the Village of Grand Bend under the Assessment Act for the 1993 taxation year, the annexed area shall be deemed to be a part of the Village of Grand Bend. O.Reg. 788/92, s. 6.

SCHEDULE

Portion of the Township of Stephen to be annexed to the Village of Grand Bend described as follows:

Beginning at the intersection of the southerly boundary of the Village of Grand Bend and the westerly boundary of the Township of Stephen being in the middle of the Ausable River;

Thence southerly along the westerly boundary of the said Township to the westerly prolongation of the southerly limit of Lot 4 in the Aux Sable Concession;

Thence easterly to and along the southerly limit of Lot 4 to the line between the easterly and westerly halves of Lot 4;

Thence northerly along the line between the easterly and the westerly halves of lots 4, 3 and 2 in the said Concession to the southerly limit of Lot 1;

Thence northerly and parallel with the easterly limit of Lot 1, 372.5 metres to a point;

Thence easterly and parallel with the southerly limit of Lot 1, 580 metres to the easterly limit of Lot 1;

Thence northerly along the easterly limit of Lot 1 and the northerly prolongation thereof to the centre line of the King’s Highway Number 81;

Thence northerly to an angle in the Village of Grand Bend at the intersection of the northerly limit of the said King’s Highway and the westerly limit of Lot 1 in Concession A of the Township of Stephen;

Thence westerly and southerly along the southeasterly boundaries of the said Village to the place of beginning.
