PHOTO-RADAR SYSTEM — PART XIV.1 OF THE HIGHWAY TRAFFIC ACT

This Regulation is made in English only.

1. (1) In this section,

“subject motor vehicle” means a motor vehicle the rate of speed of which is measured by a photo-radar system.  O. Reg. 500/94, s. 1 (1).

(2) A photo-radar system is a device that,

(a) calculates in kilometres per hour the rate of speed at which a subject motor vehicle is being driven by measuring the relative movement between the device and the subject motor vehicle;

(b) takes a photograph of the subject motor vehicle, whether or not other vehicles are in the camera’s field of view, at the moment of calculation of the rate of speed at which the subject motor vehicle is being driven;

(c) shows or superimposes on the photograph the rate of speed at which the subject motor vehicle is being driven, together with the date and time at which the photograph is taken and the rate of speed calculated.  O. Reg. 500/94, s. 1 (2).

(3) A photograph obtained through the use of a photo-radar system may show or have superimposed on it information in addition to that referred to in clause (2) (c), but the inclusion or omission of such additional information does not prevent the photograph from being used for its intended purpose under this or any other Act.  O. Reg. 500/94, s. 1 (3).

(4) The following device constitutes a photo-radar system:

1. Gatsometer Gatso Radar Type 24 with traffic camera types AUS or AUS-D for mobile and stationary controls.  O. Reg. 500/94, s. 1 (4).

2. Revoked:  O. Reg. 333/95, s. 1.

3. (1) A statement containing information from the records of the Ministry certified by the Registrar of Motor Vehicles under the seal of the Ministry constitutes evidence of ownership of a vehicle for the purposes of Part XIV.1 of the Act.  O. Reg. 500/94, s. 3 (1).

(2) If the statement is made by electronic means in an electronic format, the information contained in the statement may be displayed in Form 1.  O. Reg. 500/94, s. 3 (2).

4. (1) A likeness in all material respects of a photograph, including the information shown or superimposed upon the photograph pursuant to clause 205.1 (2) (b) of the Act, is a photographic equivalent of the photograph for the purposes of section 205.6 of the Act.  O. Reg. 500/94, s. 4 (1).

(2) The photographic equivalent may be reproduced by electronic, optical, chemical or any other means.  O. Reg. 500/94, s. 4 (2).

5. A certificate of striking out conviction shall be in Form 103 of Regulation 200 of the Revised Regulations of Ontario, 1990.  O. Reg. 500/94, s. 5.
