1. The Public Guardian and Trustee shall establish and maintain a register of,
(a) guardians of property; and
(b) guardians of the person. O. Reg. 99/96, s. 1.
2. The Public Guardian and Trustee shall open a file relating to a person and shall incorporate the file in the register when the first of the following events occurs:
1. The Public Guardian and Trustee becomes the person’s statutory guardian of property.
2. The court appoints someone as the person’s guardian of property or guardian of the person. O. Reg. 99/96, s. 2.
3. (1) A file in the register relating to a person shall contain the following information that is in the possession of the Public Guardian and Trustee:
1. The name and address of the person.
2. The name, address and telephone number of the person’s guardian of property, if any, and guardian of the person, if any.
3. For each guardian referred to in paragraph 2, information concerning,
i. how the guardian acquired his or her authority,
ii. any restrictions on the guardian’s authority,
iii. with respect to a guardian of the person, whether the authority is full or partial and, if partial, the areas of personal care decision making in which the guardian has authority, and
iv. the date that the guardian’s authority took effect, terminated or changed. O. Reg. 99/96, s. 3 (1).
(2) The Public Guardian and Trustee shall update the information contained in the register whenever he or she receives new information referred to in subsection (1). O. Reg. 99/96, s. 3 (2).
4. A guardian of property or guardian of the person shall promptly notify the Public Guardian and Trustee in writing of,
(a) any change in the name, address or telephone number of the guardian; and
(b) any change in the name or address of the person. O. Reg. 99/96, s. 4.
5. When the court makes an order relating to the appointment or authority of a guardian of property or guardian of the person, the person who made the application shall promptly send the Public Guardian and Trustee a copy of the order. O. Reg. 99/96, s. 5.
6. (1) The Public Guardian and Trustee shall provide information contained in the register under section 3 to any person who requests the information, by telephone or otherwise, if the person identifies by name the person to whom the file relates. O. Reg. 99/96, s. 6 (1).
(2) The Public Guardian and Trustee shall not provide any information in response to a request under subsection (1) except as authorized by that subsection. O. Reg. 99/96, s. 6 (2).
7. The Public Guardian and Trustee shall inform every guardian about whom information is kept in the register about,
(a) the existence of the register;
(b) the nature of the information kept in the register, as set out in section 3; and
(c) the circumstances, as set out in section 6, under which information from the register may be released. O. Reg. 99/96, s. 7.
