WASTE DISPOSAL SITES AND WASTE MANAGEMENT SYSTEMS SUBJECT TO APPROVAL UNDER OR EXEMPT FROM THE ENVIRONMENTAL ASSESSMENT ACT

Note: On the day subsection 2 (1) of Schedule 7 to the Open for Business Act, 2010 comes into force, the title to the Regulation is revoked and the following substituted:

WASTE DISPOSAL SITES, WASTE MANAGEMENT SYSTEMS AND SEWAGE WORKS SUBJECT TO APPROVAL UNDER OR EXEMPT FROM THE ENVIRONMENTAL ASSESSMENT ACT

This Regulation is made in English only.

1. A waste disposal site or waste management system is exempt from sections 30 and 32 of the Environmental Protection Act if it is or forms part of an undertaking that,

Note: On the day subsection 2 (1) of Schedule 7 to the Open for Business Act, 2010 comes into force, section 1 is amended by striking out “A waste disposal site or waste management system is exempt from sections 30 and 32” in the portion before clause (a) and substituting “A waste disposal site, waste management system or sewage works is exempt from being the subject matter of a hearing under section 20.15”. See: O. Reg. 247/11, ss. 2, 4.

(a) is subject to section 5 of the Environmental Assessment Act; or

(b) is exempt from section 5 of the Environmental Assessment Act under section 15.1 of that Act. O. Reg. 206/97, s. 1.

2. (1) The use, operation or establishment of a waste disposal site is exempt from section 30 of the Environmental Protection Act if the establishment of the site is exempt from section 5 of the Environmental Assessment Act under Ontario Regulation 101/07 (Waste Management Projects) made under that Act. O. Reg. 105/07, s. 2.

(2) The alteration, extension or enlargement of a waste disposal site is exempt from section 30 of the Environmental Protection Act if the alteration, extension or enlargement is exempt from section 5 of the Environmental Assessment Act under Ontario Regulation 101/07. O. Reg. 105/07, s. 2.
