NOTICE REQUIREMENTS FOR DELEGATIONS OF AUTHORITY

1. (1) This section prescribes the notice to be given before the Minister makes an order, under subsection 4 (2.1) of the Act, delegating authority to the council of a municipality. O. Reg. 297/97, s. 1 (1).
(2) Notice must be given by personal service, fax or mail to the clerk of the municipality. O. Reg. 297/97, s. 1 (2).
(3) Notice must be given at least 14 days before the order is made. O. Reg. 297/97, s. 1 (3).
(4) The notice must set out the authority that is to be delegated and the approximate date the delegation is to come into force. O. Reg. 297/97, s. 1 (4).
2. (1) This section prescribes the notice to be given before the Minister makes an order, under subsection 4 (2.2) of the Act, delegating authority to a planning board. O. Reg. 297/97, s. 2 (1).
(2) Notice must be given by personal service, fax or mail to the secretary-treasurer of the planning board and to the clerk of each municipality within the planning area for which the planning board was established. O. Reg. 297/97, s. 2 (2).
(3) Notice must be given at least 14 days before the order is made. O. Reg. 297/97, s. 2 (3).
(4) The notice must set out the authority that is to be delegated and the approximate date the delegation is to come into force. O. Reg. 297/97, s. 2 (4).
3. (1) This section prescribes the notice to be given before a regional, county or district council or the council of the County of Oxford passes a by-law, under subsection 51.2 (2) of the Act, delegating authority to a constituent local or area municipality. O. Reg. 297/97, s. 3 (1).
(2) Notice must be given by personal service, fax or mail to the clerk of the constituent local or area municipality and to the Director of the Provincial Planning Services Branch of the Ministry of Municipal Affairs and Housing. O. Reg. 297/97, s. 3 (2).
(3) Notice must be given at least 14 days before the by-law is passed. O. Reg. 297/97, s. 3 (3).
(4) The notice must set out the authority that is to be delegated and the approximate date the delegation is to come into force. O. Reg. 297/97, s. 3 (4).
4. (1) This section prescribes the notice to be given before a county or city council passes a by-law, under subsection 51.2 (3) of the Act, delegating authority to a municipal planning authority. O. Reg. 297/97, s. 4 (1).
(2) Notice must be given by personal service, fax or mail to the secretary-treasurer of the municipal planning authority and to the Director of the Provincial Planning Services Branch of the Ministry of Municipal Affairs and Housing. O. Reg. 297/97, s. 4 (2).

5. For the purposes of this Regulation, the giving of notice shall be deemed to be completed,
(a) where notice is given by personal service, on the day that the serving of all required notices is completed;
(b) where notice is given by fax, on the day that the faxing of all required notices is completed; and
(c) where notice is given by mail, on the day that the mailing of all required notices is completed. O. Reg. 297/97, s. 5.
