CHANGES TO THE HYDRO-ELECTRIC
COMMISSIONS OF THE TOWNS OF
BRACEBRIDGE, GRAVENHURST
AND HUNTSVILLE

This Regulation is made in English only.

1. For the purpose of subsection 210.4 (2) of the Act, this Regulation applies to The Corporation of the Town of Bracebridge, The Corporation of the Town of Gravenhurst and The Corporation of the Town of Huntsville, referred to in this Regulation as the municipalities, and to their hydro-electric commissions. O. Reg. 397/97, s. 1.

2. (1) Each of the municipalities may by by-law terminate the term of office of all the members of its hydro-electric commission who hold office under subsection 130 (4) of the District Municipality of Muskoka Act.

(2) Upon the passing of a by-law under subsection (1), the hydro-electric commission of the municipality shall be composed of the mayor of the municipality and two or four persons who are qualified electors in the municipality under the Municipal Elections Act, 1996 and who are appointed by by-law.

(3) Subsection (1) applies despite subsection 130 (4) of the District Municipality of Muskoka Act.

(4) The municipalities shall not pass a by-law under subsection (1) before December 1, 1997. O. Reg. 397/97, s. 2.

3. (1) Upon the passing of a by-law under subsection 2 (1), and at the beginning of the term of each newly-elected municipal council after a regular election, the municipality shall pass a by-law appointing two or four persons, as described in subsection 2 (2), to the hydro-electric commission of the municipality.

(2) The council of a municipality shall not, after passing a by-law under subsection (1), pass a by-law changing the number of persons appointed to the hydro-electric commission of the municipality during its term of office; however, it may pass a by-law appointing a person to replace any member who resigns or is unable to complete his or her term of office and a subsequently-elected municipal council may, in its by-law described in subsection (1), change the number of persons appointed to the hydro-electric commission of the municipality from the number appointed by its predecessor council.

(3) The persons appointed to the hydro-electric commission by by-law shall hold office until the end of the term of office of the members of the municipal council that appointed them or until their successors are appointed. O. Reg. 397/97, s. 3.
