ONTARIO REGULATION 238/98

DELEGATION OF AUTHORITY — LAKEHEAD RURAL PLANNING BOARD AND THE MUNICIPALITY OF NEEBING

Consolidation Period: From May 20, 1998 to the e-Laws currency date.

No amendments.

This Regulation is made in English only.

1. (1) The Minister’s authority to give consents under sections 50 and 53 of the Act with respect to applications made before May 20, 1998 for which the file numbers are 58-C-960008 and 58-C-970011 is delegated to the Lakehead Rural Planning Board. O. Reg. 238/98, s. 1 (1).

(2) The delegation of authority is subject to the condition that the Board shall comply with the rules of procedure contained in Schedule 4 to Ontario Regulation 136/95 when exercising the delegated authority. O. Reg. 238/98, s. 1 (2).

2. On December 31, 1998, the delegation of authority to the Lakehead Rural Planning Board under section 1 with respect to applications made on or before December 31, 1998 for land in the geographic townships of Pearson and Scoble as they exist on December 31, 1998 is terminated. O. Reg. 238/98, s. 2.

3. (1) On and after January 1, 1999, the Minister’s authority to give consents under sections 50 and 53 of the Act with respect to applications made on or before December 31, 1998 for land in the geographic townships of Pearson and Scoble as they exist on December 31, 1998 is delegated to the council of The Corporation of the Municipality of Neebing. O. Reg. 238/98, s. 3 (1).

(2) The delegation of authority is subject to the following conditions:

1. The council shall comply with the rules of procedure contained in Schedule 4 to Ontario Regulation 136/95 when exercising the delegated authority.

2. If the authority delegated to the council is in turn delegated by the council to a committee of council or an appointed officer or a committee of adjustment, the council shall forward to the Minister a certified copy of the delegating by-law within 15 days after it is passed. 4. A delegation of authority made by this Regulation is not terminated by reason only that the conditions set out in this Regulation are not complied with. O. Reg. 238/98, s. 4.
