TAX MATTERS — TAXATION OF CERTAIN RAILWAY, POWER UTILITY LANDS

Historical version for the period March 31, 2004 to June 29, 2004.

This Regulation is made in English only.

1. This Regulation applies with respect to land described in paragraphs 1 and 2 of subsection 315 (1) of the Municipal Act, 2001.  O. Reg. 392/98, s. 1; O. Reg. 81/04, s. 1.

2. The tax rates set out in Table 1 are prescribed, for the geographic areas described in subsection 315 (6) of the Municipal Act, 2001, as the tax rates for school purposes for the purposes of section 257.7 of the Act.  O. Reg. 392/98, s. 2; O. Reg. 81/04, s. 2.

3. (1) Despite section 2, for land that is owned by the owner on December 31, 1997, the tax rates set out in Tables 2 to 6 for the municipality or territory in which the land is located are prescribed as the tax rates for school purposes for 1998 for the purposes of section 257.7 of the Act.  O. Reg. 392/98, s. 3 (1).

(2) The headings of the columns of Tables 2 to 6 that set out the tax rates are references to the names of the assessed owners as they appear on the assessment rolls except that the headings set out in Table 7 refer to the names of the assessed owners indicated in that Table.  O. Reg. 392/98, s. 3 (2).

(3) If the land is leased to the assessed owner by a municipality, the applicable tax rate is the tax rate set out in Tables 2 to 6 for that assessed owner.  O. Reg. 392/98, s. 3 (3).

4. (1) Despite section 2 and subject to subsections (2), (3) and (4), for land owned by the owner on December 31, 1997, the tax rates set out in Tables 2 to 6 for the municipality or territory in which the land is located are prescribed as the tax rates for school purposes for 1999 for the purposes of section 257.7 of the Act.  O. Reg. 343/99, s. 1; O. Reg. 408/99, s. 1 (1).

(2) If the tax rate for a municipality or territory set out in Table 2, 3, 4, 5 or 6 is greater than the tax rate that applies for the municipality or territory in Table 1, the tax rate determined under subsection (1) for that municipality or territory shall be reduced by one-seventh of the difference.  O. Reg. 343/99, s. 1.

(3) If the tax rate for a municipality or territory set out in Table 2, 3, 4, 5 or 6 is less than the tax rate that applies for the municipality or territory in Table 1, the tax rate for the land for 1999 shall be increased by one-seventh of the difference.  O. Reg. 343/99, s. 1.

(4) The tax rates for school purposes for 1999 for the purposes of section 257.7 of the Act with respect to land that is owned by the owner on December 31, 1997 and located in a municipality or territory set out in Table 8, 9, 10 or 11 are the tax rates set out in those Tables for the municipality or territory in which the land is located.  O. Reg. 408/99, s. 1 (2).

(5) The headings to the columns of Tables 2 to 6 and 8 to 11 that set out the tax rates are references to the names of the assessed owners as they appear on the assessment rolls except that the headings set out in Table 7 refer to the names of the assessed owners indicated in that Table.  O. Reg. 408/99, s. 1 (2).

5. A designated electricity utility, as defined in subsection 19.0.1 (5) of the Assessment Act, is prescribed as a power utility for the purposes of paragraph 2 of subsection 315 (1) of the Municipal Act, 2001.  O. Reg. 343/99, s. 1; O. Reg. 81/04, s. 3.

6. (1) Despite section 2 and subject to subsections (2), (3) and (4), for land described in subsection 315 (1) of the Municipal Act, 2001 that was owned by the owner on December 31, 1997 and is still owned by the same owner on January 1, 2000, the tax rates determined under section 4 for the municipality or locality in which the land is located are prescribed as the tax rates for school purposes for 2000 for the purposes of section 257.7 of the Act.  O. Reg. 515/00, s. 1; O. Reg. 133/02, s. 1 (1); O. Reg. 81/04, s. 4.

(2) If the tax rate for the municipality or territory determined under section 4 is greater than the tax rate that applied for the municipality or territory in Table 1, the tax rate determined under subsection (1) for that municipality or territory shall be reduced by one-sixth of the difference.  O. Reg. 515/00, s. 1.

(3) If the tax rate for the municipality or territory determined under section 4 is less than the tax rate that applied for the municipality or territory in Table 1, the tax rate determined under subsection (1) for that municipality or territory shall be increased by one-sixth of the difference.  O. Reg. 515/00, s. 1.

(4) The tax rate for school purposes for 2000 for the purposes of section 257.7 of the Act with respect to land located in a municipality or territory set out in Table 12, 13, 14, 15 or 16 that was owned by an owner on December 31, 1997, and still owned by the same owner on January 1, 2000, is the tax rate that is set out in the Table for the municipality or territory in which the land is located.  O. Reg. 133/02, s. 1 (2).

(5) The headings to the columns of Tables 12 to 16 that set out the tax rates are references to the names of the assessed owners as they appear on the assessment rolls or to the names set out in Column 1 of Table 7 opposite the names of the assessed owners set out in Column 2 of that Table.  O. Reg. 133/02, s. 1 (2).

7. (1) Despite section 2 and subject to subsection (2), for land described in subsection 315 (1) of the Municipal Act, 2001 that was owned by the owner on December 31, 1997 and is still owned by the same owner on January 1, 2001, the tax rates determined under section 6 for the municipality or locality in which the land is located are prescribed as the tax rates for school purposes for 2001, for the purposes of section 257.7 of the Act.  O. Reg. 258/01, s. 1; O. Reg. 81/04, s. 5.

(2) If the tax rate for the municipality or territory determined under section 6 is greater than the tax rate that applied for the municipality or territory in Table 1, the tax rate determined under subsection (1) for that municipality or territory shall be reduced by one-fifth of the difference.  O. Reg. 258/01, s. 1.

(3) The tax rate for school purposes for 2001 for the purposes of section 257.7 of the Act with respect to land located in a municipality or territory set out in Table 17, 18, 19, 20 or 21 that was owned by an owner on December 31, 1997, and still owned by the same owner on January 1, 2001, is the tax rate that is set out in the Table for the municipality or territory in which the land is located.  O. Reg. 133/02, s. 2.

(4) The headings to the columns of Tables 17 to 21 that set out the tax rates are references to the names of the assessed owners as they appear on the assessment rolls or to the names set out in Column 1 of Table 7 opposite the names of the assessed owners set out in Column 2 of that Table.  O. Reg. 133/02, s. 2.

8. (1) Despite section 2 and subject to subsection (2), for land described in subsection 315 (1) of the Municipal Act, 2001 that was owned by the owner on December 31, 1997 and is still owned by the same owner on January 1, 2002, the tax rates determined under section 7 for the municipality or locality in which the land is located are prescribed as the tax rates for school purposes for 2002, for the purposes of section 257.7 of the Act.  O. Reg. 133/02, s. 3; O. Reg. 81/04, s. 6.

(2) If the tax rate for the municipality or territory determined under section 7 is greater than the tax rate that applied for the municipality or territory in Table 1, the tax rate determined under subsection (1) for that municipality or territory shall be reduced by one-fourth of the difference.  O. Reg. 133/02, s. 3.

9. (1) Despite section 2 and subject to subsection (2), for land described in subsection 315 (1) of the Municipal Act, 2001 that was owned by the owner on December 31, 1997 and is still owned by the same owner on January 1, 2003, the tax rates determined under section 8 for the municipality or locality in which the land is located are prescribed as the tax rates for school purposes for 2003, for the purposes of section 257.7 of the Act.  O. Reg. 81/04, s. 7.

(2) If the tax rate for the municipality or territory determined under section 8 is greater than the tax rate that applied for the municipality or territory in Table 1, the tax rate determined under subsection (1) for that municipality or territory shall be reduced by one-third of the difference.  O. Reg. 81/04, s. 7.
