TRANSITION ASSISTANCE GRANTS, NO. 2

This is the English version of a bilingual regulation.

1. (1) A board specified in Column 1 of the document referred to in section 2 shall be paid a grant with respect to a matter set out in Column 2 of the document opposite the board’s name in an amount for which the board provides proof of payment satisfactory to the Minister with respect to that matter, so long as,

(a) subject to subclause (c) (i), the total amount paid to the board with respect to that matter does not exceed the amount set out in Column 3 of the document, opposite the board’s name and the matter;

(b) Revoked: O. Reg. 97/02, s. 1 (1).

(c) if the board is a board set out in Column 1 of Table 1 to Ontario Regulation 124/98 opposite items 1 to 12,

(i) the total amount of the grants paid under this Regulation to the board in respect of matters set out in Column 2 of the document referred to in section 2 opposite the board’s name does not exceed the difference between the sub-total amount set out in Column 3 of that document for the board and the amount set out in Column 2 to Table 1 to Ontario Regulation 124/98 opposite the board’s name,

(ii) the board satisfies the Minister that it has spent the amount set out in Column 2 of Table 1 to that Regulation on the matters set out in Column 2 to the document referred to in section 2 of this Regulation opposite the board, and

(iii) the proof of payment does not relate to any part of the amount referred to in subclause (ii); and

(d) the proof of payment respecting matters other than severance set out in Column 2 of the document referred to in section 2 shows that payment was made before August 31, 2002. O. Reg. 476/98, s. 1 (1); O. Reg. 97/02, s. 1 (1, 2).

(1.1) For the purposes of this Regulation, the document referred to in section 2 shall be read with the following changes:

1. In Column 3, opposite Kawartha Pine Ridge District School Board in Column 1 and the word “Severance” in Column 2, “21,822” is changed to “542,822”.

2. In Column 3, opposite Trillium Lakelands District School Board in Column 1 and the word “Severance” in Column 2, “708,000” is changed to “955,000”.

3. In Column 3, opposite Hamilton-Wentworth District School Board in Column 1 and the word “Severance” in Column 2, “2,351,987” is changed to “3,133,987”.

4. In Column 3, opposite CSD du Grand Nord de l’Ontario in Column 1 and the words “School Board Administration” in Column 2, “150,000” is changed to “440,000”.

5. In Column 3, opposite CSD des écoles catholiques du Sud-Ouest in Column 1 and the words “Organisation administrative” in Column 2, “398,687” is changed to “1,014,687”.

6. The subtotal for each board is changed to reflect the changes made by paragraphs 1 to 5.

7. The document is changed by adding a row, as follows:

i. “Limestone District School Board” is set out in Column 1 of the row.

ii. “DEVELOPMENT/IMPLEMENTATION OF TELECOMMUNICATIONS” is set out in Column 2 of the row.

iii. “750,000” is set out in Column 3 of the row. O. Reg. 531/00, s. 1; O. Reg. 97/02, s. 1 (3).

(1.2) For the purposes of this Regulation, the first attachment referred to in paragraph 3 of the Schedule to the regulation, entitled “School Board Restructuring Program, Phase 2, Application for Reimbursement of Labour Adjustment Costs — Guideline”, shall be read with the following changes:

1. With respect to the District School Board Ontario North East, the Superior-Greenstone District School Board, the Toronto District School Board and the Ottawa-Carleton District School Board, the sentence “In no case can costs incurred beyond December 31, 1999 be considered for funding under this initiative.” is changed to “In no case can costs incurred beyond August 31, 2003 be considered for funding under this initiative.”.

2. With respect to other boards, the sentence “In no case can costs incurred beyond December 31, 1999 be considered for funding under this initiative.” is changed to “In no case can costs incurred beyond August 31, 2001 be considered for funding under this initiative.”. O. Reg. 531/00, s. 1; O. Reg. 97/02, s. 1 (4).

2. The document referred to in section 1 is entitled “School Board Restructuring Program — Board Summary” and dated August 10, 1998 and is available for public inspection at the Business Services Branch of the Ministry, located on the 21st floor, 900 Bay Street, Toronto. O. Reg. 476/98, s. 2; O. Reg. 97/02, s. 2.

3. The grant, if any, paid to a board under section 1 with respect to severance shall not exceed the amount set out in Column 2 of the Table opposite the name of the board. O. Reg. 97/02, s. 3.

4. (1) If the Minister is satisfied that a board whose name is set out in Column 1 of the Table has paid an amount before August 31, 2002 with respect to a matter, other than severance, that is set out in Column 2 of the document referred to in section 2 opposite the name of the board in Column 1 of that document, a grant is payable to the board with respect to the matter equal to the amount paid by the board, less all grants, if any, paid to the board under section 1 in respect of the same matter. (2) Despite subsection (1), the total of all grants paid to a board under subsection (1) shall not exceed the amount set out in Column 3 of the Table opposite the name of the board. O. Reg. 97/02, s. 3.

5. (1) If the Minister is satisfied that a board has paid an amount before August 31, 2002 with respect to a matter, other than severance, that is set out in Column 2 of the document referred to in section 2 opposite the name of the board in Column 1 of that document, a grant is payable to the board with respect to the matter equal to the amount paid by the board, less the total of all grants, if any, paid to the board under section 1 or 4 in respect of the same matter. (2) Despite subsection (1), the total of all grants paid to a board under this section shall not exceed the amount by which “A” exceeds “B”, in which,

“A” is the total of all amounts in Column 3 of the document referred to in section 2 that are set out opposite,

(a) the name of the board in Column 1 of that document, and

(b) matters in Column 2 of that document, other than severance, and

“B” is the sum of all grants, if any, received by the board under section 1 or 4, or under both sections, in respect of those matters. O. Reg. 97/02, s. 3.

6. (1) Despite sections 3, 4 and 5, no grant is payable to a board in respect of a matter set out in Column 2 of the document referred to in section 2 unless the following conditions are satisfied:

1. The payment by the board in respect of the matter is made in accordance with the terms and conditions set out in the memoranda and attachments described in the Schedule.

2. If the grant is in respect of a matter set out entirely in capital letters in Column 2 of the document referred to in section 2, the board made the expenditure in respect of the matter in accordance with a communications technology plan,

i. that was agreed to by all of the boards having jurisdiction in the area to which the plan applies, and

ii. that was approved by the Minister. O. Reg. 97/02, s. 3.

(2) The Minister shall approve a communications technology plan referred to in paragraph 2 of subsection (1) if the plan provides for a co-ordinated system of communication to enable the boards to which the plan applies to communicate efficiently with their schools, with each other and with the Ministry.
