Amending Reg. 826 of R.R.O. 1990

(Designation of Area of Development Control)

1. Regulation 826 of the Revised Regulations of Ontario, 1990 is amended by adding the following section:

20. Despite section 2, paragraph 25 of the Schedule to Regulation 683 of the Revised Regulations of Ontario, 1980, as it read on December 31, 1990, shall be deemed to read as follows:

1. In the City of Hamilton (formerly the Town of Dundas in The Regional Municipality of Hamilton-Wentworth) described as follows:

i. Beginning at the intersection of the centre line of Coldwater Creek and the southerly limit of the right-of-way for the former Toronto, Hamilton and Buffalo Railway in Lot 54, Concession I of the former Township of Ancaster;

Thence southwesterly along the centre line of Coldwater and Sulphur Creeks being the southerly boundary of the former Town of Dundas to an angle in the boundary of the Town at the midpoint, thereabouts, of Lot 46, Concession I of the former Township of Ancaster;

Thence northerly along the boundary in Lot 46 and being the westerly limit of a Plan deposited in the Hamilton Land Registry Office (Wentworth No. 62) as Number R‑221 to the northwesterly angle of this Plan;

Thence easterly along the northerly limit of Plan Number R-221 to the northeasterly angle of Part 2 within said Plan;

Thence north 5º 04' 50" west 4.871 metres to the southeasterly angle of Lot 4 within a Plan registered in the Hamilton Land Registry Office (Wentworth No. 62) as Number M-128;

Thence southeasterly in a straight line to the westerly angle of Lot 29 within a Plan registered in the Hamilton Land Registry Office (Wentworth No. 62) as Number 1389;

Thence easterly along the southerly limit of Plan Number 1389 to its easterly limit, being the westerly limit of Old Ancaster Road;

Thence easterly crossing Old Ancaster Road following a straight line to the westerly angle of a Plan registered in the Hamilton Land Registry Office (Wentworth No. 62) as Number 1327;

Thence easterly along the southerly limit of Plan Number 1327 to the southerly limit of Lot 80 within a Plan registered in the Hamilton Land Registry Office (Wentworth No. 62) as Number 1182;

Thence easterly along the southerly limit of Plan 1182 to the easterly angle of Lot 38 within said Plan;

Thence north 13º 17' west to intersect with the southerly limit of Little John Road as shown in Plan Number 1182;

Thence easterly along the southerly limit of Little John Road to the northwest angle of Lot 32 within a Plan registered in the Hamilton Land Registry Office (Wentworth No. 62) as Number 1205;

Thence south 13º 17' east 38.481 metres to a point;

Thence south 82º 17' 40" east 75.71232 metres to a point;

Thence south 58º 12' 30" east 129.14376 metres to a point;

Thence north 70º 01' 25" east 125.761 metres to a point;

Thence north 43º 14' 05" east to intersect with the southerly limit of the former lands of the Toronto, Hamilton and Buffalo Railway;

Thence easterly along the southerly limit of the former railway lands in Lot 54, Concession I of the former Township of Ancaster to the place of beginning.

ii. Beginning at the intersection of the easterly limit of Lot 45, Concession I of the former Township of Ancaster and the southerly limit of the lands of the former Toronto, Hamilton and Buffalo Railway;

Thence northerly along the easterly limit of Lot 45 to intersect with the southerly limit of Lot 74 within a Plan registered in the Hamilton Land Registry Office (Wentworth No. 62) as Number 62M-485;

Thence westerly along the southerly limit of Plan Number 62M-485 to the southwesterly angle of Lot 61 in said Plan, being the southeasterly angle of Lot 1 within a plan registered in the Hamilton Land Registry Office (Wentworth No. 62) as Number 62M-676;

Thence westerly along the southerly limits of Lots 1 to 15 and the northeasterly, southeasterly and southerly limits of Lots 17 to 27 to the easterly limit of Block 61 within Plan 62M-676;

Thence northerly along the easterly limits of Block 61 to its northeasterly angle;

Thence westerly along the northerly limit of Block 61 to intersect with the westerly limit of Lot 44 in Concession I of the former Township of Ancaster;

Thence southerly along the westerly limit of Lot 44 to intersect with the southerly limit of the lands of the former Toronto, Hamilton and Buffalo Railway;

Thence easterly along the southerly limit of the lands of the former Toronto, Hamilton and Buffalo Railway to the place of beginning.

iii. Beginning at the intersection of the southerly boundary of the former Town of Dundas and the easterly limit of Lot 43 in Concession I of the former Township of Ancaster;

Thence westerly, northerly and easterly along the southerly, westerly and northerly boundaries of the former Town of Dundas to intersect with the easterly limit of Lot 11 in Concession I of the former Township of West Flamborough;

Thence southerly along the easterly limit of Lot 11 to the northeasterly angle of a Plan registered in the Hamilton Land Registry Office (Wentworth No. 62) as Number 62R-6454;

Thence westerly along the northerly limit of Plan 62R‑6454 to the westerly limit of Lot 10 in Concession I;

Thence northerly along the westerly limit of Lot 10 to intersect with the southeasterly angle of Part 2 within a Plan registered in the Hamilton Land Registry Office (Wentworth No. 62) as Number 62R-3895;

Thence north 11º 40' west 120.93 metres to a point;

Thence south 62º 53' 20" west 120.12 metres to a point;

Thence south 15º 40' 10" east to the southerly limit of Part 2 of Plan 62R-3895;

Thence westerly along the southerly limit of Part 2 of Plan 62R-3895 to its southwesterly angle;

Thence southwesterly in a straight line to an angle on the westerly limit of Part 1 in Plan 62R-3895 denoted by a standard iron bar located north 76º 05' 50" east 203.508 metres from the westerly limit of Lot 8 at the center line of Lot 8, Concession I in the former Township of Flamborough;

Thence southerly along the westerly limit of Part 1 to the northerly limit of Governor’s Road;

Thence westerly along the northerly limit of Governor’s Road to intersect with the northerly prolongation of the easterly limit of Lot 43 in Concession I of the former Township of Ancaster;

Thence southerly along that northerly prolongation and the easterly limit of Lot 43 to the place of beginning.
