Amending O. Reg. 231/08

(Transit Projects and Greater Toronto Transportation Authority Undertakings)

1. The title to Ontario Regulation 231/08 is revoked and the following substituted:

 

TRANSIT PROJECTS AND METROLINX UNDERTAKINGS

2. Subsection 2 (1) of the Regulation is revoked and the following substituted:

Exemption conditional on compliance with transit project assessment process

(1) A transit project that belongs to a class of transit projects described in Schedule 1 is exempt from Part II and subsection 13 (3) of the Act if the proponent has commenced the transit project assessment process and complies with that process.

3. Subsection 3 (1) of the Regulation is amended by striking out “Part II of the Act” at the end and substituting “Part II and subsection 13 (3) of the Act”.

4. Subsection 4 (1) of the Regulation is revoked and the following substituted:

Metrolinx undertakings

(1) Any undertaking of Metrolinx that is described in section 6, 7, 8 or 8.1 of the Metrolinx Act, 2006 is exempt from Part II and subsection 13 (3) of the Environmental Assessment Act.

5. (1) Subsection 1 (1) of Schedule 1 to the Regulation is amended by striking out “the Greater Toronto Transportation Authority” in the portion before paragraph 1 and substituting “Metrolinx”.

(2) Subsection 2 (1) of Schedule 1 to the Regulation is amended by striking out “the Greater Toronto Transportation Authority” in the portion before paragraph 1 and substituting “Metrolinx”.

6. Item 17 of the Table to section 1 of Schedule 2 to the Regulation is amended by striking out “Greater Toronto Transportation Authority” in Column 2 and substituting “Metrolinx”.

7. This Regulation comes into force on the day it is filed.
