Amending O. Reg. 258/98
(RULES OF THE SMALL CLAIMS COURT)
1. Clauses 8.02 (c), (k) and (l) of Ontario Regulation 258/98 are revoked and the following substituted:
Corporation
(c) on any other corporation, by leaving a copy of the document with,
(i) an officer, a director or an agent of the corporation, or
(ii) a person at any place of business of the corporation who appears to be in control or management of the place of business;
. . . . .
Partnership
(k) on a partnership, by leaving a copy of the document with,
(i) any one or more of the partners, or
(ii) a person at the principal place of business of the partnership who appears to be in control or management of the place of business; and
Sole Proprietorship
(l) on a sole proprietorship, by leaving a copy of the document with,
(i) the sole proprietor, or
(ii) a person at the principal place of business of the sole proprietorship who appears to be in control or management of the place of business.
2. Subparagraph 1 iii of subrule 9.02 (1) of the Regulation is amended by striking out “and fax number if any” at the end and substituting “fax number if any, and Law Society of Upper Canada registration number if any”.
3. Subparagraph 1 v of subrule 10.01 (4) of the Regulation is amended by striking out “and fax number if any” at the end and substituting “fax number if any, and Law Society of Upper Canada registration number if any”.
4. Subrule 11.1.01 (2) of the Regulation is amended by adding the following paragraph:
2. All settlement conferences required under Rule 13 have been held.
5. The Table of Forms to the Regulation is amended by striking out,

Commencement
6. (1) Subject to subsection (2), this Regulation comes into force on the later of July 1, 2012 and the day it is filed.
(2) Section 4 comes into force on the later of January 1, 2013 and the day this Regulation is filed.
