Amending O. Reg. 253/07

(FIREFIGHTERS)

1. (1) Section 4 of Ontario Regulation 253/07 is amended by adding the following paragraphs:

9. Primary-site breast cancer.

10. Multiple myeloma.

11. Primary-site testicular cancer.

(2) Section 4 of the Regulation is amended by adding the following paragraph:

12. Primary-site prostate cancer.

(3) Section 4 of the Regulation is amended by adding the following paragraph:

13. Primary-site lung cancer.

(4) Section 4 of the Regulation is amended by adding the following paragraph:

14. Primary-site skin cancer.

2. (1) Subsection 5 (2) of the Regulation is amended by striking out “primary-site brain cancer” and substituting “primary-site brain cancer, primary-site breast cancer or primary-site testicular cancer”. 

(2) Subsection 5 (3) of the Regulation is amended by striking out “primary acute lymphocytic leukemia or primary-site ureter cancer” and substituting “primary acute lymphocytic leukemia, primary-site ureter cancer or multiple myeloma”. 

(3) Subsection 5 (3) of the Regulation, as amended by subsection (2), is amended by striking out “primary-site ureter cancer or multiple myeloma” and substituting “primary-site ureter cancer, multiple myeloma or primary-site prostate cancer”. 

(4) Subsection 5 (3) of the Regulation, as amended by subsection (3), is amended by striking out “multiple myeloma or primary-site prostate cancer” and substituting “multiple myeloma, primary-site prostate cancer or primary-site skin cancer”. 

(5) Section 5 of the Regulation is amended by adding the following subsection:

(3.1) The presumption in subsection 15.1 (4) of the Act does not apply in respect of primary-site lung cancer unless,

(a) the worker was employed as a full-time firefighter, part-time firefighter or fire investigator or served as a volunteer firefighter for a total of at least 15 years before being diagnosed; and

(b) the worker did not smoke a tobacco product in the 10 years before being diagnosed. 

Commencement

3. (1) Subject to subsections (2) to (4), this Regulation comes into force on the day it is filed.

(2) Subsections 1 (2) and 2 (3) come into force on January 1, 2015.

(3) Subsections 1 (3) and 2 (5) come into force on January 1, 2016. 

(4) Subsections 1 (4) and 2 (4) come into force on January 1, 2017.
