Amending O. Reg. 347/04

(AGENTS)

1. (1) The definition of “accident and sickness insurance licence” in subsection 1 (1) of Ontario Regulation 347/04 is amended by striking out “clause 393 (2) (b) of the Act” and substituting “paragraph 2 of subsection 392.2 (2) of the Act”.

(2) The definition of “general insurance licence” in subsection 1 (1) of the Regulation is amended by striking out “clause 393 (2) (c) of the Act” and substituting “paragraph 3 of subsection 392.2 (2) of the Act”.

(3) The definition of “life insurance licence” in subsection 1 (1) of the Regulation is amended by striking out “clause 393 (2) (a) of the Act” and substituting “paragraph 1 of subsection 392.2 (2) of the Act”.

2. Section 4 of the Regulation is amended by adding the following subsections:

(2.1) An individual shall be deemed, for the purposes of clause 4 (1) (d) only, to meet the qualifications described in that clause if he or she is applying for the renewal of a life insurance licence and the Superintendent is satisfied that the individual was previously deemed to have met the qualifications. 

(2.2) An individual shall be deemed, for the purposes of clause 4 (1) (e) only, to meet the qualifications described in that clause if he or she is applying for the renewal of an accident and sickness insurance licence and the Superintendent is satisfied that the individual was previously deemed to have met the qualifications. 

(2.3) An individual shall be deemed, for the purposes of clause 4 (1) (g) only, to continue to have the qualifications tested by the examination referred to in clause 4 (1) (d) if,

(a) the Superintendent is satisfied that the individual continues to have the qualifications tested by the Level II life insurance examination; and

(b) the individual,

(i) previously passed that examination, or

(ii) was previously determined by the Superintendent to have the qualifications tested by that examination.

(2.4) An individual shall be deemed, for the purposes of clause 4 (1) (g) only, to continue to have the qualifications tested by the examination referred to in clause 4 (1) (e) if,

(a) the Superintendent is satisfied that the individual continues to have the qualifications tested by the examination approved by the Superintendent for individuals who applied before January 1, 2003 to write the examination for accident and sickness insurance licenses; and

(b) the individual,

(i) previously passed that examination, or

(ii) was previously determined by the Superintendent to have the qualifications tested by that examination.

3. Subsection 7 (2) of the Regulation is revoked and the following substituted:

(2) Despite subsection (1), subsection 3 (1) of this Regulation does not apply in respect of an application for the renewal of a life insurance licence if the applicant has held a life insurance licence for at least two years.

4. Subsection 9 (1) of the Regulation is amended by striking out “Subsection 393 (23) of the Act” at the beginning and substituting “Subsection 392.2 (6) of the Act”.

5. Subsection 10 (2) of the Regulation is amended by striking out “subsection 393 (6) of the Act” and substituting “subsections 392.6 (1), (2) and (3) of the Act”.

6. Sections 18 to 23 of the Regulation are revoked.

Commencement

7. This Regulation comes into force on the later of the day section 15 of Schedule 3 to the Fighting Fraud and Reducing Automobile Insurance Rates Act, 2014 comes into force and the day this Regulation is filed.
